Researchers have determined the function of a new variant of enzyme IKKalpha (IKK±) is to activate some of the genes taking part in the tumor progressions of colorectal cancer. CAMDEN, N.J. - The summary judgment granted in March to a commercial laundry accused of occupational exposure to toluene by one of the company's drivers was affirmed Sept. 17 in the U.S. District Court for the District of New Jersey, and the presiding judge reconsidered and granted the print shop defendant summary judgment on negligence and loss of consortium claims alleged by the driver (Brian Steele, et uxor v. Aramark Corp., et al., No. 09-4340, D. N.J.; 2012 U.S. Dist. Lexis 132206; See 4/3/12, Page 9).

NEW ORLEANS - A unanimous Louisiana Fourth Circuit Court of Appeal panel on Sept. 7 affirmed class certification and the verdict for class representatives in a merits trial of personal injury claims for exposure to calcium hydroxide; the panel also assigned liability to two of the insurers for the owner of the source of the toxicant (Michelle Marshall, et al. v. HOUSTON - Iraq war contractors sued in the U.S. District Court for the Southern District of Texas by Iraq war veterans for exposing them to hexavalent chromium at an oil extraction site in Iraq filed a petition on Sept. 4 in the Fifth Circuit U.S. Court of Appeals to challenge the Aug. 16 orders denying motions to dismiss for lack of jurisdiction pursuant to the political question doctrine and the combat activities exception in the Federal Tort Claims Act; the veterans opposed the interlocutory appeal in a response filed Sept. 14 (Mark McManaway, et al v. KBR Inc., et al., No. 12-90064, 5th Cir.).

SANTA ANA, Calif. - The special master in the U.S. District Court for the Eastern District of California assigned to recommend a settlement allocation plan in a hexavalent chromium flood damage mass tort case recommended Sept. 12 that the court adopt a four-level plan with payments ranging from $1,000 to $25,000; the $5 million flood damage settlement agreement was approved in July (Raul Valencia Abarca, et al. v. PORTLAND, Ore. - The Iraq War contractors sued in the U.S. District Court for the District of Oregon by Oregon National Guard members for exposure to hexavalent chromium at Qarmat Ali in Iraq moved Sept. 17 to strike the jury demand and punitive damages claim on the grounds that the contract with the United States bars the plaintiffs from a jury trial and from collecting punitive damages; a bellwether trial for the claims of 12 guard members is to begin Oct. 9 (Rocky Bixby, et al. v. According to a BioSpace report, the U.S Food and Drug Administration (FDA) has granted orphan-drug designation to paclitaxel poliglumex (OpaxioT) for the treatment of glioblastoma multiforme, a malignant brain cancer.
Paclitaxel poliglumex is an investigational, biologically enhanced, chemotherapeutic compound that links paclitaxel to a biodegradable polyglutamate polymer, resulting in a new chemical entity. Preclinical studies have demonstrated that paclitaxel poliglumex appears to be tumour selective and does not appear to enhance radiation toxicity to normal tissues.
