6th Circuit Panel Affirms Black Lung Benefits Award For Change In Condition
CINCINNATI - A unanimous Sixth Circuit U.S. Court of Appeals issued an opinion Aug. 8 affirming the award of black lung disability benefits and declined to adopt an interpretation of the federal regulations that would require benefits boards to interpret evidence of a change of condition based on a claimant's prior condition (Cumberland River Coal Co. v.
