The 9th U.S. Circuit Court of Appeals is expected to release its opinion on the constitutionality of California&amp;#8217;s voter-approved ban on same-sex marriage Tuesday morning.
The appeals court is deciding whether to uphold or reverse a federal judge&amp;#8217;s 2010 ruling that Proposition 8, which was approved by voters in 2008, was unconstitutional. Regardless of the outcome, the decision is expected to be appealed to the United States Supreme Court.
The opinion will be posted online at 10 a.m, according to a press release from the court.

Democrats have lost their solid political party affiliation advantage in 18 states since 2008, while Republicans have gained a solid advantage in 6 states. A total of 17 states were either solidly Republican or leaning Republican in their residents&amp;#8217; party affiliation in 2011, up from 10 in 2010 and 5 in 2008. Meanwhile, 19 states including the District of Columbia showed a solid or leaning Democratic orientation, down from 23 in 2010 and 36 in 2008. The remaining 15 states were relatively balanced politically, with neither party having a clear advantage.

U.S. unemployment, as measured by Gallup without seasonal adjustment, increased slightly to 8.6% in January from 8.5% in December, but was down from 9.9% in January a year ago.
And underemployment surged:
Underemployment, a measure that combines the percentage of workers who are unemployed with the percentage working part time but wanting full-time work, surged to 18.7% in January. This is a worsening from the 18.3% of December but is still below the 19.0% of a year ago


Well, there has been a deterioration and not any dramatic improvement since the first of the year.

Republican registered voters nationally continue to prefer Newt Gingrich over Mitt Romney for the 2012 GOP presidential nomination, with no sign in Gallup Daily tracking from Jan. 22-26 that Gingrich is giving back any of his recent gains.
The 32% of Republican voters now choosing Gingrich as the candidate they are most likely to support for the nomination is his highest level of support since the 2012 primary voting began in early January. The 24% supporting Romney is his lowest.
Despite the heavy media focus on the two front-runners, Ron Paul and Rick Santorum are each holding their own at just under 15%, putting the two men in a statistical tie for third.

Are wealthier Americans really not paying their fair share? Here are some numbers on income inequality:
1. The top 1% pay 36.7% of fed income taxes, earn 16.9% of adjusted gross income (as of 2009).
2. The top 0.1% pay 17.1% of taxes, earned 7.8% of adjusted gross income.
3. The average income tax rate for top 1% is 24%. The bottom 50%? Just 1.85%.
4. The bottom 50% pay just 2.3% of income taxes.
5. Buffett chose to leave most of his fortune to the Bill &amp; Melinda Gates Foundation, avoiding 55% estate tax.

According to the latest Gallup Poll.
Mitt Romney has edged ahead of Newt Gingrich, 27% to 23%, for the national lead among Republican voters for the first time since Gallup Daily tracking of the Republican race began on Dec. 1. Ron Paul remains in deep third place with 11% of the GOP vote, followed by Rick Perry at 8%.

He is now campaigning in Iowa and will be there over the weekend. His campaign smells a win in Iowa, which is somewhat reflected in the national poll results above.

House Speaker John Boehner says he has reached agreement with the Senate to renew the payroll tax cut before it expires Dec. 31.
The Ohio Republican said in a statement Thursday that he expects to pass a new bill by Christmas that would renew the tax break for two months while congressional negotiators work out a longer-term measure that would also extend jobless benefits for millions of Americans and prevent doctors from absorbing a big cut in Medicare payments.

Mitt Romney and Newt Gingrich essentially tie President Barack Obama in the 2012 presidential election preferences of registered voters nationwide. Fifty percent of registered voters would support Obama in each hypothetical matchup, while 48% would give their vote to Gingrich or Romney.
The USA Today/Gallup survey, conducted Dec. 15-18, finds a slight improvement in Gingrich&amp;#8217;s standing versus Obama, but no change in Romney&amp;#8217;s. In Gallup&amp;#8217;s previous trial heats, conducted as part of its Daily tracking Dec. 6-7, Romney was statistically tied with Obama, as he has been in all of Gallup&amp;#8217;s Romney-Obama matchups to date. Former House Speaker Newt Gingrich now trails President Obama by double digits, his second straight weekly decline since becoming the GOP frontrunner.
The latest Rasmussen Reports national telephone survey of Likely Voters finds Obama earning 49% of the vote, while Gingrich receives 39% support.&amp;nbsp; Eight percent (8%) prefer some other candidate, and another four percent (4%) are not sure.
So, the Obama electability issue will confront Gingrich going into tomorrow night&amp;#8217;s debate.
And, a key ad meme in Iowa &amp;#8211; by Ron Paul and Rick Perry.
Last week , Obama led Gingrich by a five-point margin, 45% to 40%. In late November, Gingrich held a slight 45% to 43% edge over the president.

Newt Gingrich continues to lead the field of candidates for the Republican nomination, though his lead over Mitt Romney has shrunk slightly from last week. Currently, 31% of Republican registered voters nationwide say they are most likely to support Gingrich for the nomination, compared with 22% choosing Romney, with all other candidates in single digits.
These results are based on interviews with 1,167 Republicans and Republican-leaning registered voters in Dec. 8-12 Gallup Daily tracking.
