By Tim LynchOver the weekend, the Wall Street Journal ran an excellent article about the problem of overcriminalization—the proliferation of criminal laws and how more and more people can find themselves on the wrong side the law without even realizing it. Here’s an excerpt:
In 2009, Mr. Anderson loaned his son some tools to dig for arrowheads near a favorite campground of theirs. Unfortunately, they were on federal land. Authorities “notified me to get a lawyer and a damn good one,” Mr. Anderson recalls.
There is no evidence the Andersons intended to break the law, or even knew the law existed, according to court records and interviews. But the law, the Archaeological Resources Protection Act of 1979, doesn’t require criminal intent and makes it a felony punishab...

: Very interesting look in photos at typical weekly shopping for families around the worldThese images are from the book 'Hungry Planet: What the World Eats' by Peter Menzel and Faith D'Aluision. It's an inspired idea, to better understand the human diet, explore what culturally diverse families eat for a week. Their portraits feature pictures of each family with a week's worth of food purchases. We soon learn that diet is determined by largely uncontrollable forces like poverty, conflict and globalization, which can bring change with startling speed. Thus cultures can move, sometimes in a single jump, from traditional diets to the vexed plenty of global-food production. People have more to eat and, too often, eat more of nutritionally questionable food. And their health suffers.Nutritioni...

By David RittgersDepartment of Education officers employed a SWAT team because of unpaid student loans. I am not making this up:
Kenneth Wright does not have a criminal record and he had no reason to believe a S.W.A.T team would be breaking down his door at 6 a.m. on Tuesday…
As it turned out, the person law enforcement was looking for was not there – Wright’s estranged wife.
“They put me in handcuffs in that hot patrol car for six hours, traumatizing my kids,” Wright said.
Wright said he later went to the mayor and Stockton Police Department, but the City of Stockton had nothing to do with Wright’s search warrant.
The U.S. Department of Education issued the search and called in the S.W.A.T for his wife’s defaulted student loans.
This, along with the J...

By David RittgersIn my post on Brian Aitken’s plight, I discussed New Jersey’s draconian gun laws and how a law-abiding citizen can become a victim of overbroad laws. New Jersey gun laws weren’t always so bad, but overcriminalization warped them into their current unconstitutional state.
This trend is a staple of modern legislative activity. Every time a politician says that we must pass a new law to “get tough on crime” and that their pet legislation ought to be passed “for the children,” it’s a sure indicator that the rule of law is about to take another body blow. Take, for instance, the crusade against sexting that threatens to make foolish teenagers into sex offenders. Or the proposed federal cyberbullying act, which aims to turn teens into federal felons, in spite of...

By David RittgersA federal prosecutor’s misconduct tilted the scales of justice against Antonio Lyons, an Orlando businessman. Lyons served three years in prison before his attorney discovered statements from a witness that differed from the testimony given at trial. That was just the tip of the iceberg.
For more than a week in 2001, the jurors listened to one witness after another, almost all of them prison inmates, describe how Lyons had sold them packages of cocaine. One said that Lyons, who ran clothing shops and nightclubs around Orlando, tried to hire him to kill two drug dealers.
But the federal prosecutors handling the case did not let the jury hear all the facts.
Instead, the prosecutors covered up evidence that could have discredited many of Lyons’ accusers. They never di...

For an example of how our federal criminal laws have morphed into a leviathan that threatens the liberty of average citizens, take the case of inventor and entrepreneur Krister Evertson:
In May 2004, FBI agents driving a black Suburban and wearing SWAT gear ran Evertson off the road near his mother’s home in Wasilla, Alaska. When Evertson was face down on the pavement with automatic weapons trained on him, an FBI agent told him he was being arrested because he hadn’t put a federally mandated sticker on a UPS package.
A jury in federal court in Alaska acquitted Evertson, but the fed...

“For yesterday is but a dream, and tomorrow is only a vision” is part of the Sanskrit proverb quoted at the beginning of the book which has become one of the basic building blocks for a life of sobriety.
In addition to a thought, meditation and prayer for each day of the year, this handy, pocket-sized volume also contains the Serenity Prayer and the 12 Steps and 12 Tradit...

This could be the one. There's been lots of films in the last few years trying to tackle the issues surrounding the epidemic of Chronic Disease in the West that is now starting to take hold in the far East. Most of them have been a little too earnest for general consumption, too many excuses for Doctors to be dismissive. This film could be different. Here we have a clinician and a scientist jointly presenting their evidence to argue that heart disease, cancer and diabetes is more a choice than an inheritance. The problem is how to get those most in need to realise they have a choice for optimum health.Better diet and health is not profitable enough for global corporations - there will be no Pharmaceutical company investing millions of Dollars of PR, advertising and Lobbyists' time on this Nat...

Have you cheated the guy in the glass
When you get what you want in your struggle for self,
And the world makes you King for a day,
Then go to the mirror and look at yourself,
And see what that guy has to say.
For it isn’t your Father, or Mother, or Wife,
Who judgement upon you must pass.
The feller whose verdict counts most in your life
Is the guy staring back from the glass.
He’s the feller to please, never mind all the rest,
For he’s with you clear up to the end,
And you’ve passed your most dangerous, difficult test
If the guy in the glass is your friend.
You may be like Jack Horner and “chisel” a plum,
And think you’re a wonderful guy,
But the man in the glass says you’re only a bum
If you can’t look him straight in the eye.
You can...

By Tim LynchYesterday, Michael Dreeben, the attorney representing the U.S. government, tried to defend the controversial “honest services” statute from a constitutional challenge in front of the Supreme Court. When Dreeben informed the Court that the feds have essentially criminalized any ethical lapse in the workplace, Justice Breyer exclaimed,
[T]here are 150 million workers in the United States. I think possibly 140 [million] of them flunk your test.
There it is. Some of us have been trying to draw more attention to the dangerous trend of overcriminalization. Judge Alex Kozinski co-authored an article in my book entitled “You’re (Probably) a Federal Criminal.” And Cato adjunct scholar, Harvey Silverglate, calls his new book, Three Felonies a Da...

Federal Cyberbullying Law: ‘Worth a Try’?

On Wednesday the House Judiciary Committee’s Subcommittee on Crime, Terrorism, and Homeland Security held a hearing on the proposed cyberbullying legislation I mentioned in this post. Cato adjunct scholar Harvey Silverglate testified at the hearing, and his written testimony is available here.
Silverglate highlighted the pernicious potential of this law, which sits at the nexus of his two books. The Shadow University highlights how speech codes have impaired free expression on college campuses nationwide. Three Felonies a Day shows how federal criminal law has expanded to define various innocuous activities as federal felonies. Put the two together and a federal cyberbullying law is what you get. Silverglate’s recent podcast is available here, and he recently appeared at a Cato book fo...

Federal prosecutors moved to criminalize internet harassment last year by prosecuting Lori Drew. Lori Drew, as you may recall, is a Missouri woman who created a fictional MySpace profile named “Josh” and started an online relationship with Megan Meier, a teenage girl who may have spread gossip about Drew’s daughter at the local high school. After “Josh” broke up with her, Megan Meier killed herself.
While this is despicable conduct, Missouri prosecutors found that Drew had broken no criminal statute and could not be prosecuted.
Enter Thomas O’Brien, U.S. Attorney for the Central District of California. O’Brien filed charges against Drew based on alleged violations of the Computer Fraud and Abuse Act (CFAA). O’Brien alleged that by violating MySpace’s policy requiring fact...

Harvey Silverglate’s new book, Three Felonies a Day: How the Feds Target the Innocent, is receiving a good bit of press. L. Gordon Crovitz has a good piece up at the Wall Street Journal discussing federal overcriminalization and how it impacts information technology. National Review Online has an audio interview with Silverglate discussing how federal law often strays from traditional notions of criminal intent, making innocent activity potentially criminal.
Silverglate will be speaking at Cato on Thursday at a book forum with Tim Lynch. Tim’s recent book In the Name of Justice looks at the evolution of strict liability statutes and other developments in criminal law with chapters from prominent legal thinkers. Washington Times columnist Tony Blankley will be serving as guest moderator...

BBC NEWS | Health | Tomato pill beats heart diseaseWhy would you want to eat more fruit and vegetables a day when you can just take a pill?Because there's not £££ millions of pounds to made from eating more fruit and vegetables?Fresh fruit and vegetables have a multitude of immune boosting nutrients in them all working in synergy and with very few, if any detrimental side effects.Science is restricted by the the obcession to isolate one chemical, to find the one silver bullet. Consequently they still really don't don't 'know' why people who eat more fruit and vegetables are far healthier than average. To get a sensible answer to that question you'd probably be better off speaking to a good nutritionist (Source: Healthy Eating & Nutrition News)

One of the internet autism related groups noticed an rather odd online 'advertisement' in which yesterday's Apeldoorn killer (a man drove deliberately into the public with the goal to hurt the Queen) was linked to autism. Yes, autism in the spotlights once again. So, with many others I sent an e-mail to the website owners and another mail to the author himself in which I showed my anger to such ignorance and discriminating publications.Well, the website sent a general response to my complaint....and the advertisement was removed this evening!Once again this is a true succes for people with autism. The killer was described as being a silent, intelligent man who lived a very withdrawn life. There are many of such people who do not have autism. The driver of the car yesterday, the killer, died...

Imagine you wake up one day, and someone tells you that your autism has gone. What would you do? Would you feel free? Will you miss the "special" feeling of being autistic? Can not imagine what I would do. I think when my autism would have been gone, there will be some kind of damaged personality left anyway. The pain, the grief will always be there. Hmmm, would I like it?? I have my doubts.Every morning I seem to have trouble starting up the day. There is always the thought of 'o yes, another day with autism', followed with a sigh. What about you? Every day is new, every day is like inventing the wheel again. (Source: The Art of Being Asperger Woman)

This study therefore suggest that social approval bias might well be a substantial problem in the interpretation of nutritional intervention effects that are dependent on education and awareness to affect behavior change. The magnitude of this bias is similar to the intervention effects reported in many studies evaluating changes in fruit and vegetable intake (ranging from 0.93 to 1.25 servings per day). Thus, a major challenge facing nutritional intervention researchers is assessing true behavioral change based on self-reports from reporting bias.

This doesn’t mean that health questionnaires are useless. Rather, it means that many people simply aren’t being entirely truthful when it comes to how many fruits and vegetables they eat. The authors suggest that, in large dietary i...

Or two. DEX makes us temporarily diabetic by messing with the glucose transport system, which decreases the body's normal ability to move glucose out of the blood and into muscles and other organs.

I have a blood glucose monitor and did a simple study of my own blood glucose, taking a reading every half hour or so all day long, on four different sore-fingered days. Here is the bottom line result, where Day 1 is the next day after taking the DEX the previous evening. The "glucose" value is an average for the whole day, expressed in mg/dL:

Day Dose mg Glucose Comment

2 40 101
5 40 88 DEX effect must be gone

By Dov Michaeli MD, Ph.D A recent editorial in the Journal of the American Society of Nephrology reviewing all the evidence to back up the claims of “drink 8 glasses of water a day” drew my attention to the whole subject of “medical myths”. Every physician could attest to episodes of irate true believers refusing to accept any criticism or skepticism. To my astonishment, I came across many physicians who vehemently believe in those urban myths. It is a curious observation of mine: There exists an inverse correlation between the amount and quality of the evidence and temperature: the less light the greater the heat. It is as if you attacked a central tenet of their beliefs, shaking up their view of the world. Even in scientific meetings I have witnessed many hea...

Filed under: Prevention, American Heart Association, Exercise, Aging Heart HealthAre you getting enough activity? The American Heart Association and the American College of Sports Medicine recently released new guidelines on how much exercise we should all be getting. Former guidelines suggested that, at a minimum, we should all be doing 30 minutes of moderate exercise most days of the week. The AHA and ACSM took that a step or two further and recommended:

30 minutes of moderate exercise 5 days per week, OR
20 minutes of vigorous exercise 3 days per week, AND
strength training, including 8-10 different exercises, two days per week

They also encourage seniors to be more active and to focus on exercises that will promote strength, balance, and flexibility. In addition, the two groups...
