The Unconscious Situation of Date Rape

This article takes seriously the proposition that many men are telling the truth when they say that they honestly believed that a woman in a date rape case had consented when she in fact did not do so. The article argues, however, that the men are generally truthful at a conscious level, while being aware unconsciously that the truth is otherwise. Furthermore, the absence of conscious awareness is the result of self-deception. Drawing on research in philosophy and cognitive psychology, this article defines the various forms of self-deception and explains how they work in date rape cases. Date rape liability often involves a negligence analysis: Should the man have known of the woman’s non-consent? Yet the penalties imposed for negligent date rape are often quite severe, more so than ...

Here's How Your Marriage or Relationship Can Survive Domestic Violence

We recently published two controversial posts here on Blisstree, Domestic Violence Debate: It’s Not Wrong for Women to Hit Men and the follow-up, Women vs. Men: The Domestic Violence Double-Standard, but your heated comments told us that we weren’t quite finished with this often-taboo subject. However, I knew we needed a specific type of expert to weigh in on the tricky debates that surround issues of domestic violence. So, based on the recommendation of a clinical psychologist friend, I tracked down Dr. Linda G. Mills, who’s a professor of social work, public policy, and law at NYU, as well as a recognized authority on the subjects of violence and recovery. I asked her eight questions that challenge the typical perception of domestic violence (she prefers the term &#8220...

An Example of the Constant Threat of Violence Against Trans Women

On April 18th, a transgender woman, Chrissy Lee Polis, was beaten at a McDonald’s near Baltimore, MD. Trans women experience violence and the threat of violence constantly, but what made this case rise to public notice was that a McDonald’s employee stood by and videotaped the assault, and then posted it to the internet.
The video was not made to document the assault for the victim, it was made for “entertainment” value. People can be heard laughing. Almost nobody actually tries to help the victim. As the Baltimore Sun reports, “Throughout the attack, a man is filming and does not intervene. But when the victim appears to have a seizure, he yells, “She having a seizure, yo. … Police on their way. Y’all better get out of here.” The McDonald&...

By Tim LynchFrom today’s Washington Post:
During his campaign, Obama supported reintroducing the lapsed assault weapon ban, promised to eliminate an amendment requiring the FBI to destroy records of gun buyers’ background checks and advocated closing the gun-show loophole. Since taking office, the president has done none of that, and before the midterm elections, he shelved a proposal requiring gun dealers to report bulk sales of high-powered semiautomatic rifles. In his State of the Union address, just weeks after the Giffords shooting in January, Obama made no mention of guns. … Other leading Democrats, even those traditionally willing to offer full-throated support for gun-control efforts, have grown surprisingly less vocal as they take on more of a national role.

Recently, I wrote a Blisstree post called Domestic Violence: It’s Not Wrong for Women to Hit Men, which, based on some of your comments, seems to have struck a nerve (no pun intended). So, because you took the time and effort to make said comments, I thought I’d take a few of your most heated responses and answer them point by point.
A Blisstree reader named “J” had this to say:
What would be better is if weak, emotional women such as Valerie learned to express themselves in non-violent means. Violence of any sort is usually the response of a frustrated, angry person who lashes out. Certainly not the action of an intellectual adult.
Hey, J.
I’m not really sure where you got the idea that I ever express myself in violent means. I actually don&...

Usually I’m fiercely against double-standards, but I have to admit: I don’t think that a woman hitting a man is the same thing as a man hitting a woman. Don’t get me wrong: I’m anti-domestic violence (physical and emotional), or any violence for that matter, but I just don’t believe that if a woman hits a man, the ramifications are the same as when the reverse happens.
Now, I’m not talking about slugging your boyfriend or husband with a brass-knuckled left hook. Or smashing him over the head with a portrait painting. Or bludgeoning him with a blunt object. Obviously these acts are wrong, violent, and possibly a felony. I don’t mean pulling a Lorena Bobbitt or a Phil Hartman’s wife or a Francine Hughes in The Burning Bed (alt...

CBS correspondent Lara Logan in Egypt
On Tuesday, CBS News announced that foreign correspondent Lara Logan was beaten and sexually assaulted while covering Egypt’s revolution. “In the crush of the mob, she was separated from her crew. She was surrounded and suffered a brutal and sustained sexual assault and beating before being saved by a group of women and an estimated 20 Egyptian soldiers,” CBS said.
This horrific situation has unfortunately been made even uglier thanks to an outpouring of vitriol on various Web outlets. The comments section of Gawker’s post on the assault became so choked with a mélange of victim-blaming toward Logan and racism toward her attackers that the post’s author, Hamilton Nolan, was forced to move “what seemed like the most egre...

In less than six months after I wrote ”Seven Reasons Why Pregnancy Becomes a Deadly Affair,” the public outrage is faint and inaudible regarding domestic violence committed against pregnant women. The subject therefore needs to be revisited again.
On a college campus less than 90 minutes away from my home, a 17-year-old woman was kicked and punched in her abdomen for no apparent reason other than that she carried life within her womb. The alleged father of her baby, Devin Nickels, a college student at Florida State University (FSU), was apparently not happy about his new prospective role. He purportedly contacted a high school buddy, Andres Luis Marrero, who now attended the University of Tampa, and asked him to beat his girlfriend until she had a miscarriage for $200.00. Rape is not controversial. It’s just wrong. But it’s clear from your dozens of comments that the concept of rape fantasies (obviously very different from rape) is extremely controversial – and even taboo. Now, when I say “rape fantasy,” I mean a safe scenario in the bedroom between or among consenting adults.
Personally, I don’t see anything wrong with rape fantasies. Why should they be different from any other sexual fantasy that gets played out in the be...

Private Practice's recent rape scene was more graphic and realistic than most, but does sexual assault belong on primetime TV?
For better or worse, sexual assault is all over media: When we sat down to think of famous rape scenes on film and TV, we came up with so many, we made a second list. Typically, rape is either depicted as a terrible, violent crime, or glorified as part of a sexual fantasy. The former scene type made its most recent appearance on ABC’s Private Practice last Thursday, when Charlotte King (sexology specialist, Chief of Staff at St. Ambrose Hospital, and fiancee to Cooper) was violently raped in her office by a mentally disturbed man.
Network television can only get so graphic (even after 10 p.m.), and, as a nighttime soap opera, Private Practice does have a ...

Myths and Facts about Drug-Facilitated Sexual Assault
Self-help is the best protection against drunk and drugged sexual assault.

You wake up in a strange bed. Your head is pounding, your muscles ache, and you have no memory of the night before. The last thing you remember is heading to a party with some friends – everything after that is gone. Then, a memory fires in your mind. You’re not sure, but you think you’ve been drugged and sexually assaulted.
This scenario is what most people think of when they think of drug-facilitated sexual assault – a woman being assaulted after having "date-rape" drugs such as Rohypnol® ("Roofies") slipped into her drink. In reality, this only represents a small piece of the bigger picture of this crime. To hel...

We don’t like rape. Rape sucks. Rape is wrong. Rape is bad. Rape is against the law. Still, a fair number of film and TV characters really seem to ask for it a lot. (Or maybe it’s that most film and TV directors are men. Wait a minute…) Obviously, these disturbing scenes exist for a reason, but what? To provoke thought, to promote dialogue, to teach, to titillate? Are these alleged rape “fantasies” supposed to be the character’s, the director’s – or ours? How the hell should we know? Blisstree didn’t get a Ph.D. in cinema studies. Instead, we present our gallery of the top 10 rape fantasy scenes on film and TV. (Tell us if we missed any – you sickos.)

Everyone knows prison isn’t the nicest place in the world – we’ve all caught a minute or two of Lockdown on MSNBC or Locked Up Abroad on NatGeo. One would hope that those governing the prisons would be principled individuals; after all, inmates are in prison for committing a crime, and you’d think the guards would set an example. If that sounds a little too Hollywood, it is. According to a recent Mother Jones article, inmates at the Ohio Reformatory for Women who complained of abuse by guards were thrown into the hole (solitary confinement). As Just Detention International (formerly Stop Prisoner Rape) points out, the process of banishing prisoners to solitary confinement after reporting an incident discourages them from reporting abuse – and encoura...

There really is a dizzying array of stuff we can do to get ourselves in legal hot water in EMS. I was considering a few this afternoon and I got this idea.
Let’s play a game. I’ll give you a whole list of scenarios and you match the legal transgression to the act. OK, that was a really boring and overly technical way to describe my game.
I’ll say what they did; you tell me what they did wrong. Sound like fun? I agree. Let’s begin.
Here are all the possible answers:

Sounds OK to me
Negligence
Battery
Abandonment
Assault

Jot your answers down on a scrap of paper. I’ll be back on Thursday with my answers and the rationale behind them.

My new post on Politics Daily / Woman Up:

2nd Lt. Emily J.T. Perez, 1983-2006
It started with a picture — 2nd. Lt. Emily J.T. Perez. In her United States Military Academy photograph, she holds her feathered hat, grips her sword and smiles. Perez had a lot to smile about. She was the first minority female command sergeant in West Point history.
And she was the first combat death from the class of 2005, also known as the class of 9/11. In 2006, a roadside bomb south of Baghdad killed her.
Then there was a PBS special I watched. The program was titled, simply, “The Marines.” It was a 90-minute program that seemed more like a recruiting film than a documentary. And I wasn’t the only one who thought so, as many of the critics who wrote to the PBS ombudsman made clear.

There is no question more women than ever before are surviving breast cancer. This is happening because of early screening and better and more aggressive treatment. So I was absolutely shocked today to hear that the United States Preventive Services Task Force (a committee appointed by the U.S. Department of Health and Human Services) is now recommending that women do not get regular mammograms until their fifties and even then limit screening to every other year. In addition they are suggesting that breast self exams not be taught. ARE THEY CRAZY?
There is no way to completely express my feelings about this. I was diagnosed with stage 3 breast cancer at the age of 44, and the tumor was discovered through self breast exam and confirmed through a mammogram. This was only 18 months since a p...

I’ve been hearing a bit about problems with and political maneuvering over the Memphis (TN) Sexual Assault Resource Center (MSARC), but I have to admit that some of the issues are a little bit too local for me to fully grasp. Luckily, blogger Steve Ross at vibinc has been on it and actually understands what’s going on. Unlike me, he’s in West Tennessee and has a good grasp of the political structure, which is very important to this story.
If I’m understanding correctly, the Center has had some incidents of way less than optimum service for victims – for example, a 14-year-old victim waiting in a parking lot with her mom for 3 hours for the forensic nurse to show up before being told to come back the next day. Then there was some talk that the County might tak...

There will be a regular autism-related blogpost tomorrow again, as I am always impressed by the variety of topics when I see all the main page of this Hub, and I think a day without a serious autism related blogpost is a waisted day. There is so much to be written about autism. Went to visit the city of Apeldoorn. Why? First reason, there is a royal palace nearby which is a museum. There are fabulous gardens and a big park one can walk through pretending to be a royal princess or more... Second reason is because of the assault on Queensday. The place where it all happens is just meters away from the museum's entrance. In the surrounding of the 'place of crime' there are two spots to rememb...

A $3 million civil rights lawsuit has been filed against the Knox County School District concerned the alleged rape of a 14-year-old girl with Asperger’s Syndrome by an alleged sex offender who, according to today’s Knox County News, had been deemed “too dangerous” by his court-appointed guardian to be unsupervised. The 18-year-old boy “was being transported to a sex offender treatment program at Halls High School when the alleged rape occurred.”
According to the lawsuit, bus owner Stanley Rudder had warned Knox County school officials the girl, identified only as Jane Doe in the lawsuit, “would not make it two days” on a special education bus crammed with “rowdy” troubled boys.
His prediction proved correct, with the girl immedia...

In what must be a world’s first, a man has been charged with assault with flatulence
A West Virginia man who was already being arrested for driving under the influence will also be facing an assault charge after he reportedly farted on a police officer while he was being fingerprinted.
Jose Cruz was hauled down to the police station in South Charleston on Monday night after he failed a series of sobriety tests.
While Cruz was being fingerprinted he intentionally moved closer to one of the officers and passed gas. Cruz was then charged with battery on an officer to go along with his DUI and obstruction charges he was already facing.
Fart = Assault and Battery? I guess we have to add “Aggressive” as another Flatulence Type

The Judge Rotenberg Center (JRC) in Canton, Massachusetts, has been called “[o]ne of the most controversial schools in the country” dues to its use of electric skin shock—aversive stimulation—”to treat children and adults with the most severe cases of autism and emotional and behavioral challenges” (from a February 2007 ABC News report). Some parents whose children have been at the JRC have defended the school on the grounds that the JRC’s aversion therapy has been the only way to stop their children’s violent and self-injurious behavior (see this December 2007 New York Times story).
I seriously question the JRC’s “treatment” methods. There have also been reports of serious lapses in administrative protocol and staff supervision at the JRC:...

18-year-old Romal Roberts, a student at Montclair High School in northern Jersey, has been accused of the gang rape of a 16-year-old special education student last Thursday at the Roberts’ house. Two other 16-year-olds have been charged. The assault occurred during school hours and involved a broomstick, today’s Bergen Record reports. Roberts has entered a plea of not guilty and is being held on $300,000 bail, the Star-Ledger reports. I don’t know what the specific diagnosis of the young woman is.
I first read about this yesterday and have been thinking about it ever since, and of why I’m glad Charlie is in a 1:1 program and never goes anywhere without a responsible party.

Mental health problems are eight times more likely if you are homeless.

Homeless people are four times more likely to use A & E Services.

If a homeless person is injured it is four times more likely to be because they have been assaulted.

The life expectancy for those sleeping rough is 42 – down from 47 a decade ago. (Source: Fade Library)

A 16-year-old student at Ramapo High School in New Jersey wears a Halloween costume that “parodies a student with autism,” the November Bergen Record reports. A week later, math teacher Lee Barber is charged with assault; according to the student (who had a history of trouble at the school and with the law), Barber swore at the student because of his costume, and grabber the student’s shirt and pushed him during an in-school suspension. Barber has been charged with assault; the charges were brought by the boy’s mother.

Not sure where the “blame” lies in this case and only hope that all parties can learn something.

Tuesday, September 25th: It’s another day at school for my son Charlie, as it is for many other children.
For 6-year-old Nathan Darnell, September 25th is a day in court. On September 7th, at Taylor Elementary School in Bracken County, Kentucky Nathan allegedly pushed an aide, Glenda Schlitz. He has been charged with fourth-degree assault, with the charges brought at the instigation of Schlitz. (Go here and here for more information, and also to the Autistic Self Advocacy Network; commentary can also be found in the comments to an earlier post).
If this seems like an overreaction to you—or even if you have concerns and are (as I am) puzzled at criminal charges addressed to a six-year-old with autism, you might express your concern by contacting some of the parties involved. Sh...

Charges have been filed against an autistic 6-year-old, Nathan Darnell, of Brooksvile, Kentucky, by a teacher’s aide, Glenda Schlitz. As reported in the September 19th Ledger Independent,
According to his parents — Catherine and Anthony Darnell — on Sept. 7, 6-year-old Nathan had allegedly refused to eat his breakfast at school and was told by the teacher’s aide in the cafeteria he could lay his head down if he ate his breakfast. When he did not do it, the aid started to leave the area. Nathan then allegedly pushed the aide, Glenda Schlitz and caused her to fall to her knees. Schiltz’s alleged injuries are unknown to the family and according to official information, the aide did not seek medical attention.
According to the family, school officials offered a o...
