The US Supreme Court ruled today that Stanford University is unable to win a patent infringement case against a Roche unit because the subsidiary held co-ownership interests in the patents. The case was being closely watched for clues to clarifying the implications of a 1980 law that allocates patent rights among the government, investors and institutions that receive federal funding.
Here’s the background: Stanford sued Roche in 2005 for patent infringement over technology to detect HIV levels blood using PCR, or polymerase chain reaction. The underlying discovery was made years earlier by a Stanford researcher, Mark Holodniy, who also worked with a company called Cetus that was later bought by Roche. However, the initial funding came from the federal government.

Over the past fewl months, several patients suffering from Fabry disease – a rare, inherited disorder that causes kidney and heart problems – have tried different ways to get a needed medication called Fabrazyme. The drug, which is made by Genzyme, has been rationed due to severe manufacturing problems that led to a consent decree for the biotech, which is now part of Sanofi-Aventis. Twice, the patients have petitioned the National Institutes of Health to allow them to break a patent; they have also petitioned the FDA to insist that overseas stock of the med is first made available to US citizens, and they are suing Genzyme and Mt. Sinai Medical Center in New York, which licensed Fabrazyme to Genzyme (back story). The outcome of their efforts is unclear, although they say Fabry patient...

On Monday, the US Supreme Court will hear this debate, which involves a dispute between Roche and Stanford University over the rights to HIV test kits (see here). The case is expected to clarify the implications of a 1980 law that allocates patent rights among the government, investors and institutions that receive federal funding.
Here’s the background: Stanford sued Roche in 2005 for patent infringement over technology to detect HIV levels blood using PCR, or polymerase chain reaction.
In response to US pricing of the Norvir AIDS drug sold by Abbott Laboratories, an advocacy group plans to petition the National Institutes of Health this month to break several patents on the drug. The forthcoming move by Knowledge Ecology International comes six years after the group failed at a similar attempt to convince the agency to override patents held by the drugmaker on the grounds that a recent 400 percent price hike was unreasonable, anticompetitive and threatened the health and safety of people with AIDS (here is the 2004 petition and the NIH denial).
In a recent report, however, KEI notes that for patients without some form of government assistance or insurance, Norvir continues to cost much more than in other countries, both those are that considered developed and less-devel...

Frustrated by the ongoing shortage of Genzyme’s Fabrazyme medication for Fabry’s disease, three patients have petitioned the US Department of Health and Human Services to override the use patents held by the troubled biotech. Their hope is to find a way to produce the drug, which is the only such treatment currently available for a rare, inherited disorder that causes kidney and heart problems.
The move comes after a year of turmoil at Genzyme, which recently agreed to pay $175 million as part of a consent decree for a raft of manufacturing problems, including viral contamination and even bits of trash found in some products. The gaffes prompted outrage from some large investors, a proxy fight by Carl Icahn and helped set the stage for the takeover bid by Sanofi-Aventis (backg...

Who owns patents that are generated by federally funded research? Roche has just filed a brief in a case before the US Supreme Court in hopes of deciding the question. The drugmaker is fighting Stanford University, which sued Roche in 2005 for patent infringement over technology to detect HIV levels blood using PCR, the polymerase chain reaction, The Tech writes.
Roche claims it is a co-owner of the patent because one of the original researchers transferred his patent rights to Cetus, which the drugmaker later purchased. In its brief, Roche argues the Bayh-Dole Act “does not alter a co-inventor’s right to assign his shared interests in an invention” and that “despite numerous requests, Stanford has never produced the actual funding agreement with the federal government that...

By Roger PilonToday Politico Arena asks:
Is Bayh’s lament on target?
My response:
The heart of Evan Bayh’s surprising announcement yesterday that he would not be seeking another term in the Senate was captured in three short sentences:
For some time, I have had a growing conviction that Congress is not operating as it should. There is too much partisanship and not enough progress — too much narrow ideology and not enough practical problem-solving. Even at a time of enormous challenge, the peoples’ business is not being done.
Beguilingly attractive as those sentiments may be, suggesting that some Golden Age of congressional comity has been lost, a candid look at our history shows that comity has been the exception, not the rule. And it’s occurred mainly w...

Why? Just ask Sen. Evan Bayh (D-IN):
You can sort of see this coming. The savings from the pharmaceutical companies and the insurance industry, you can kind of count on that because they’re not very popular.
The hospitals are a different story. People, you know, like their hospitals; they tend to trust their hospitals. The hospitals have pledged big savings. I can easily forecast at some point in the not-too-distant future the hospitals coming in and saying, “You know what, this isn’t working exactly the way we expected. Please spare us from this,” and them getting a good hearing in [Congress].
The same thing goes for physicians.
And the pharmaceutical companies.
And the insurance industry. (Source: Cato-at-liberty)

Another way to stop the Hillary-for-Veep speculation: Fire up some other speculation.
And so Obama announced this morning that he’d be campaigning in Virginia with Senator Jim Webb and former Governor Mark Warner.
Senator Webb has been touted as the Vice Presidential candidate who best augments the lack of military experience of Obama, comes from a possible pick-up state in the Electoral College, Virginia, and is a former Reagan Republican.
Flap thinks Webb is in the running and look at what Intrade says this morning:

Hillary Clinton surrogate and Superdelegate Indiana Senator Evan Byah today warns that the GOP may “Swift Boat” Barack Obama over the Jeremiah Wright Flap.
Sen. Evan Bayh (D-Ind.) today praised Sen. Barack Obama for denouncing his former pastor, but warned that Republicans will use the association to try to “Swift Boat” the Illinois senator if he becomes the Democratic presidential nominee this fall.
Bayh, who is supporting Sen. Hillary Rodham Clinton for president, said he hoped other issues — the economy, gasoline prices, health care and the cost of college — will drive the decisions of most voters in Tuesday’s Indiana primary. With the deepening Democrat Party dilemma with Hillary Clinton and Barack Obama, Hillary has resorted to an argument of electability of her candidacy in the Electoral College.
Senator Evan Bayh of Indiana, who backs Senator Hillary Rodham Clinton for president, proposed another gauge Sunday by which superdelegates might judge whether to support Mrs. Clinton or Senator Barack Obama.
