            <description>Earlier this month, an odd and controversial episode involving a Canadian drugmaker once known as Biovail finally drew to a close. Eugene Melnyk, whose tenure as chairman of Biovail was marked by turmoil and controvery, agreed to sanctions imposed by Canadian securities regulators as a result of misleading disclosures following a 2003 traffic accident involving a shipment of meds.
Earlier this year, Biovail, which is now owned by Valeant Pharmaceuticals, agreed to settle a similar lawsuit brought by the US Securities and Exchange Commission, which accused Melnyk and the drugmaker of repeatedly overstating earnings and hiding losses to meet earnings forecasts.             <description>Following through on plans announced earlier this year, Lonza is eliminating 106 jobs from its plant in Conshohocken, Pennsylvania, which makes various pharmaceutical ingredients. The Swiss company, which recently signed supply deals with GlaxoSmithKline and Human Genome Sciences (see here and here), confirmed the planned job losses in a filing with the Pennsylvania Department of Labor.
At the time the closure was first announced in January, Lonza also signaled plans to shutter two other plants - one in Shawinigan, Canada, and another in Workingham, UK - and eliminate a total of 175 jobs. A report at the time indicated that about 140 people work at the Conshohocken facility, although the status of those jobs is not clear. Lonza employs about 8,500 people worldwide.

            <description>After winning a court ruling just last week, Eugene is now backing off on his vow to oust the Canadian drugmaker&amp;#8217;s board and elect his own team at a rescheduled Biovail shareholder meeting next month, Reuters reports. Instead, Melnyk, who is Biovail&amp;#8217;s biggest shareholder, now plans to develop his own private drugmaker, which he will call Trimel Biopharma. 
The moves come just days after an Ontario judge ruled that a vote on electing the Biovail board at the June 25 shareholder meeting was taken improperly, and he ordered Biovail to reconvene its annual shareholders meeting.

Since January 2007, a total of 77 industry sites employing more than 14,000 people were either closed or have been put on notice, according to Industrial Info Resources, a research firm.

            <description>Eugene Melnyk shoots and scores. The former Biovail ceo and founder, who owns The Ottawa Senators hockey team, was handed a victory today by a Canadian court, which ordered a new vote by Biovail shareholders, Reuters reports.
The ruling came after Melnyk challenged procedures at the June 25 Biovail shareholders meeting at which he lost a proxy fight to displace the drugmaker&amp;#8217;s board. Melnyk subsequently argued in court that the meeting proceeded without a quorum. 
Melnyk had withdrawn his dissident slate of directors before the vote, leaving the meeting with less than half of the company&amp;#8217;s stock represented. The Biovail board then hastily amended the bylaws to allow the vote to proceed with only 25 percent of the shares represented. (Back story).

            <description>The Canadian drugmaker says the US Attorney in Boston is investigating activities surrounding its 2003 launch of the blood pressure med, and both civil and criminal charges may result. At issue is a program called PLACE - Proving LA through Clinical Experience - that the drugmaker used to encourage docs to prescribe the pill. (LA refers to longer acting).

And the agency is also reviewing the scientific formulation of the drug, called Budeprion XL, after a consumer-product testing group published results that showed key differences from the original drug, according to the Associated Press.
The tests, conducted by ConsumerLab.com, came after Budeprion XL users earlier this year began complaining that the drug caused severe headaches, digestive problems, anxiety, tremors, and insomnia. Another Web site, peoplespharmacy.com, reported that more than 250 people had complained about the drug. Budeprion XL is made by Impax Laboratories and sold by Teva Pharmaceutical. What&amp;#8217;s more, Biovail also agreed to pay the firm $2 million in legal fees, according to a person familiar with the proceedings.
