            <description>Earlier this week, shares in Cell Therapeutics plunged when FDA documents revealed serious concerns about the safety and effectiveness of the biotech&amp;#8217;s pixantrone med for non-Hodgkin&amp;#8217;s lymphoma. The documents were posted online in advance of a meeting that was scheduled for today, although postponed due to the latest snowstorm.
The FDA noted the drug was associated with potentially fatal cardiac side effects, including heart failure, and the agency questioned the strength of a Phase III trial, which enrolled far fewer patients than originally planned - 140 instead of 320 (click here and go to briefing documents). A federal appeals court ruled that Cell Therapeutics can pursue a claim for nearly $23 million against a former consultant, the Associated Press reports. And the 9th U.S. Circuit Court of Appeals ruling creates a new interpretation of law surrounding fraud cases brought on behalf of the government (the ruling).
The case concerns Trisenox, a leukemia drug developed by Cell Therapeutics, which claims it marketed the med off-label on the advice of a consultant, formerly known as Documedics Acquisition and now called Lash Group, the AP writes. The US Attorney in Seattle has appealed a ruling made two months ago by a federal judge, who determined that former Cell Therapeutics sales rep Jim Marchese was entitled to $1.6 million, or 15 percent of a $10.5 million fine that was paid by his former employer for off-label promotion of a cancer drug. The notice of appeal to the US District Court of Appeals for the Ninth Circuit was filed earlier this month in federal court in Seattle.

            <description>Seems my old company is now paying $10.5 million to resolve claims that they were promoting Trisenox for uses that were not approved.
Cell Therapeutics to pay $10.5 million:
I always thought they were leaving them selves open for this sort of problems back when I was working for them given the huge amount of off-label use. When a huge portion of your drug is being used for diseases it isn&amp;#8217;t approved for, you are going to raise some eyebrows.
I should note that &amp;#8220;Cell Therapeutics does not admit any wrongdoing in the matter&amp;#8221;. And we all know what that really means.
