A US appeals court has reversed a two-year-old jury verdict that found Abbott Labs had to pay $1.67 billion to Johnson & Johnson for infringing a patent on the Remicade arthritis treatment. The spat began when J&J’s Centocor Ortho Biotech unit and New York University filed a lawsuit in 2007, alleging Abbott’s rival Humira med infringed a patent relating to antibodies for treating rheumatoid arthritis.
The appeals court, however, decided the Centocor patent was invalid and lacked an adequate written description. The patent “at best, describes a plan for making fully-human antibodies and then identifying those that satisfy the claim limitation,” the court wrote. “But a ‘mere wish or plan’ for obtaining the claimed invention is not sufficie...

Are You Serious?TM A Good Example of Why Pharma Brand Managers "Love Its" TV

Many pharma marketing experts wonder why pharmaceutical marketers spend approximately 70% of their DTC advertising budgets on expensive TV advertising when they might get better bang for their bucks advertising through other channels such as the Internet. Whether or not you agree with that, there's one indisputable factor about TV advertising to consider: the opportunity for brand managers to play at being directors, mingle with the stars, and even to have a "cameo" part in the production.A good example of that is a disease awareness campaign called Are You Serious?TM, launched by Johnson & Johnson's wholly-owned Centocor Ortho Biotech division. This was described in a JNJBTW Blog guest post (here) by Craig Stoltz, Director, Product Communications, Immunology, Centocor Ortho Biotech In...

As a widely anticipated arbitration hearing nears, Johnson & Johnson is demanding unspecified amount of damages in addition to ending a partnership to sell the Remicade and Simponi rheumatoid arthritis treatments, according to a Merck filing with the US Securities and Exchange Commission.
At issue are rights to Remicade, which generated $5.5 billion in sales last year, and the newer Simponi follow-up. After Merck bought Schering-Plough, with which J&J had a co-marketing agreement, J&J claimed the takeover canceled their deal, citing a change-of-control provision. J&J subsequently filed for arbitration, which should last 12 business days with a ruling 20 days later, according to Merck.
For its part, Merck claimed its takeover was really a reverse merger that was designe...

The golf world was stunned by Tiger Woods' recent poor performance. Another bit of "stunning" news hit the golf world yesterday when the #2 ranked duffer Phil Mickelson announced that he suffers from Psoriatic Arthritis and is being treated with Enbrel. See "Phil Mickelson Arthritis: Will Play At PGA Whistling Straights". The New York Times also ran a story: "Immune Disorder Could Be an Enduring Test for Mickelson".Both these articles mentioned that he was being treated with Enbrel, a drug jointly marketed by AMGEN & PFIZER. The first article I cited includes the subtitle "PGA Championship 2010, Whistling Straits: Phil Mickelson Has Psoriatic Arthritis - Uses Enbrel To Help Manage Condition" and includes this quote from Phil: "I have no aches and pains. My back feels great. I feel stro...

The healthcare giant joins a growing list of drugmakers that are disclosing info about their financial ties to physicians. The move comes after passage of the health care reform bill, which includes a provision known as Physician Payments Sunshine that requires drugmakers each year to record - starting 2012 - all gifts and payments to docs and teaching hospitals. Posting begins in 2013.
The J&J list, however, offers both good news and bad news. The good news? J&J is disclosing payments. The bad news? Since J&J runs what are effectively different operating units, there are separate lists for separate units - which makes it difficult to get the bigger picture. The J&J units that have posted their first quarterly reports are Ortho-McNeil-Janssen, Centocor Ortho Biotech and...

An experimental drug from the Johnson & Johnson unit appears effective, but FDA medical reviewers believe the biologic could slightly increase cancer risks.
The agency reviewers indicate that ustekinumab showed positive results in two comprehensive studies, but may require labeling to warn doctors of possible carcinogenic risks. “Long-term use of ustekinumab may lead to increased risk of tumor development in psoriasis patients,” they wrote. Here is the FDA briefing document.
Centocor didn’t assess the risks in its application, and the FDA reviewers wrote that studies in mice suggest the injectable drug could encourage tumor growth. The agency said it would recommend the info is included in any labeling if the med is approved. Here is the Centocor briefing document.

The healthcare giant yesterday notified employees it will consolidate the sales and marketing operations of two subsidiaries, Ortho Biotech and Centocor, leading to roughly 400 job cuts nationwide, The Star-Ledger of New Jersey reports.
The move is a response to the declining sales of its Procrit anemia med, a spokesman tells the paper. Procrit scrips fell sharply last year after the FDA issued new safety warnings, which were also placed on anemia meds sold by Amgen. More recently, an FDA panel recommended that current use should be restricted over concerns the drugs can increase the risk of tumor growth and death.

Centocor’s 411: The Drugmaker Launches A Blog

It may not be a trend, but pharma is tip-toeing into the blogosphere. Last year, you may recall, Centocor’s parent created JNJBTW, or Johnson & Johnson By The Way, a now-and-then forum for one of the health care giant’s corporate communications people to chat about various doings and explain why J&J behaves as it does. That was quickly followed by a blog for Glaxo’s Alli, the OTC diet pill which, not surprisingly given the topic, generated more interactive discussion, albeit of the highly restricted form.
So now, Centocor is feeling emboldened and rolling out its own version, called CNTO411. Not a great name - CNTO refers to the code Centocor gives drugs under development. And the look is pretty bland. But like JNJBTW, there are hopes and dreams: “We have ...

Centocor: Security Breach Over Stolen Computers

According to a Jan. 3 letter the Johnson & Johnson unit wrote to the New Hampshire attorney general, an undetermined number of computers have gone missing and may be stolen from its Horsham, Pa., headquarters. And one or two contained sensitive personal info belonging to an unspecified number of speakers and consultants who were retained for a ‘National Faculty and Rounds on the Road’ program. (Here’s the letter).
Centocor says it was notified of the problem by its IT vendor in early October, 2007, and was provided additional details on Nov. 29th, 2007, although the drugmaker didn’t notify the New Hampshire AG until this month. The letter was written by Michael Schoeck, director of health care compliance at Johnson & Johnson, who also identifies himself as...

This morning, I posted an item about Centocor's documentary INNERSTATE and reported that SEIU Local 32BJ filed a lawsuit against J&J claiming that the company used pricing and marketing practices that lead to excessive reimbursements by Medicare, private insurers, and patients. (see "The Innerstate DVD. Is TV Next?"). I also implied that Centocor "hid" this fact and referred to a Local 32BJ protest at a screening of INNERSTATE as merely a labor issue.I'd like to make some corrections and also add a bit to the story.First, a spokesperson for the union wrote me an email and clarified who initated the law suit:"I write to correct today's entry, which says SEIU Local 32BJ filed a lawsuit against J&J. The plantiffs in the case include the federal government, various states, and other entities, ...

NOTE: Please see the follow-up post, "Innerstate: A Correction and Further Criticisms."Depending upon how well a Hollywood movie does at the box office, it usually takes six months or more before the DVD version is released and maybe a year before you can see it on paid TV channels like HBO.By that standard, Centocor's 58-minute disease awareness documentary INNERSTATE must not be doing too well in theaters: less than three months after the movie debuted in New York City, the INNERSTATE DVD arrived in my mailbox. I had signed up to attend a live presentation of the movie at the King of Prussia Mall in Pennsylvania, but decided not to go. After all, I already had a private screening (see "Innerstate Private Screening: Philadelphia Style").INNERSTATE is about patients suffering from psoriasi...

A while back, we posted about how a pharmaceutical industry group sponsored the writing of a novel that would support the group's negative point of view about reimportation of drugs from other countries. This seemed at the time to be an audacious example of stealth marketing in health care. Now, one biotechnology company has sponsored the making of a "documentary" movie, just released in theaters, that just happens to underline the suffering that having particular diseases entails, diseases that are now remarkably treatable by drugs that include the company's product. Per the Philadelphia Inquirer,Pharmaceutical promotion is going undercover to a theater near you.Starting next month, moviegoers in select cities will be able to see the heart-wrenching real stories of three people suffering f...
