Health Care Ruling a Victory for Federalism and Individual Liberty

By Ilya ShapiroToday’s ruling vindicates the constitutional first principle that ours is a government of delegated, enumerated, and thus limited powers. Like Judge Hudson in the Virginia case, Judge Vinson recognized that the individual mandate represents an unprecedented and improper incursion beyond those powers: the federal government, under the guise of regulating commerce, cannot require that people engage in economic activity.
And this is as it should be: if the only limit on congressional power were Congress’ own assessment of the wisdom of each assertion of such power, the Constitution would be obsolete — as would any conception of checks and balances. James Madison, the author of the Federalist Paper (51) explaining how man’s non-angelic nature requires ex...

First EMR Stimulus Checks

As expected the first EMR stimulus checks have been issued and we’re starting to learn who the first providers are to receive the checks. There’s even the obligatory big check picture accompanying the coverage of the first EMR stimulus checks.
According to a Government Health IT article, University of Kentucky Healthcare received a $2.86 million payment. That’s a nice chunk of change and represents a third of the hospital’s overall expected payment from CMS. I think most hospitals would enjoy a check like that. Of course, what we don’t know is how much University of Kentucky Healthcare spent to purchase and implement their EMR. I’m sure we’ll see those numbers come out as more people get their EMR stimulus checks.
The first EMR stimulus checks on t...

Now that some drugmakers are starting to disclose just how much they pay doctors for speaking engagements, a new wrinkle is emerging - some of these docs have rather questionable qualifications. Such as? Some were sanctions for prescribing unjustified or excessive meds; having inappropriate sexual relations with patients and making serious medical errors.
And the disclosures are making some drugmakers uncomfortable. Consequently, at least three pharma companies - Eli Lilly, AstraZeneca and Pfizer - now say they will take steps to monitor docs who are retained as speakers, according to ProPublica, which recently compiled several databases of info based on web site postings by drugmakers, and followed up by searching for docs who have transgressed.
This is no small matter, by the way. ProPub...

By Ilya ShapiroSlate columnist Dahlia Lithwick seems to think so (h/t David Bernstein). So I’m not accused of taking Lithwick’s words out of context, here’s the relevant passage, discussing Senate nominee Christine O’Donnell (R-DE):
O’Donnell explained that “when I go to Washington, D.C., the litmus test by which I cast my vote for every piece of legislation that comes across my desk will be whether or not it is constitutional.” How weird is that, I thought. Isn’t it a court’s job to determine whether or not something is, in fact, constitutional? And isn’t that sort of provided for in, well, the Constitution? In 2003, O’Donnell said of the Supreme Court that “it’s kind of like we have the nine people sitting th...

I cannot emphasize how important it is to know who is coming into your home.

Assist Guide Information Services (AGIS) published an article last year entitled Beware of Former Prisoner's Caring for Your Parents The article talks about prison guards advising soon-to-be released convicts that caregiving is an easy to get employment opportunity.

You need to know and understand that many individuals advertising as caregiver’s have been fired from agencies for poor conduct, theft, and other work related problems. With some exp...

More stifling of political speech.

“Checks and balances” be damned: “In a democratic country, you’d think that before the executive branch could regulate CO2–a ubiquitous substance essential to life–the legislature would have to vote on the issue.
As Tim Lynch noted earlier this week, Barack Obama’s justice department has come out in favor of renewing three controversial PATRIOT Act provisions—on face another in a train of disappointments for anyone who’d hoped some of those broad executive branch surveillance powers might depart with the Bush administration.
But there is a potential silver lining: In the letter to Sen. Patrick Leahy (D-VT) making the case for renewal, the Justice Department also declares its openness to “modifications” of those provisions designed to provide checks and balances, provided they don’t undermine investigations. While the popular press has always framed the fight as being “supporters” and “opponents” of the PATRIOT Act, the problem with many of the...

Here's the quote that captured my attention. If the Republican Party existed except as a club of groupies and roadies for the rabble-rousers on radio and cable, it would rouse itself from its narcotized self-satisfaction of second best and give a speech that the Turfers, Birthers Tea-Baggers and all the other amateurs of dissent must sit down and listen to the reason of statesmanship or else leave the halls of Congress. The GOP would tell the snipers that this is a somber, modest political party, not a cruise ship to the seventh grade. Somewhere in the outline of this speech, this make-believe worthwhile Republican Party would include the language of liberty and restraint. And then this never...

Vice-president Joe Biden says we should rally behind the Supreme Court nomination of Sotomayor because she will “have the back” of the police. Biden is a lawyer, a senator, and former chairman of the Senate’s Judiciary Committee, so he should know better than to pull a political stunt like that to curry favor with law enforcement groups. The Constitution places limits on the power of the police to search, detain, wiretap, imprison, and interrogate. The separation of powers principle means that judges must maintain their impartiality and “check” the police whenever they overstep their authority. To abdicate that responsibility and to “go along with the police” is to do away with our system of checks and balances.

It is the morning as I post this, but for those already looking forward to Happy Hour may appreciate their recipe for the Grammartini:

How to Mix a Perfect Grammartini
Pour two-and-a-half ounces of gin, a half-ounce of dry vermouth and several ice cubes into a martini shaker.
Shake. (The shaker—not your body or your dog’s paw.)
Strain into a chilled martini glass and garnish with an olive. If you must, use a lemon twist instead. The Society for the Promotion of Good Grammar likes olives, however. When life hands us lemons, we make lemonade. (Source: Organization Monkey)

“There is a silent health crisis in America… it’s that fact that, on average, American men live sicker and die younger than American women.”
- Dr. David Gremillion
Men’s Health Network
“Recognizing and preventing men’s health problems is not just a man’s issue. Because of its impact on wives, mothers, daughters, and sisters, men’s health is truly a family issue.”
-Bill Richardson
Governor, New Mexico
Since 1994, Men’s Health Week has been celebrated each year as the week leading up to and including Father’s Day. The purpose of Men’s Health Week is to heighten the awareness of preventable health problems and encourage early detection and treatment of disease among men and boys.

Shingles is a painful rash caused by the same virus that causes chicken pox, and there are about 1 million episodes of it in the United States every year. If you’ve ever had chicken pox, you are at risk for developing shingles – and your risk increases with age, especially over the age of 50 and increasing thereafter. Recently issued guidelines are now recommending immunization for all individuals over the age of 60 with a vaccine designed to prevent shingles, even if they’ve previously had an episode of shingles and even if they have a chronic medical illness. The vaccine has been available in the United States since May of 2006 and is called Zostavax. It is made using the same virus that’s in the chicken pox vaccine, which is routinely given to children and has been in use since ...

On May 11, in the midst of Mental Health Awareness Month, The New York Times ran a provocative article titled ‘Mad Pride’ Fights a Stigma, which reported on the burgeoning movement to destigmatize mental illness through proud – if not downright aggressive – acceptance, rather than shame-based avoidance. Taking their cue from other previously marginalized groups such as gay-rights activists, some advocates are going public with their mental health stories, using books and online blog and video posts. There are Web sites such as the Icarus Project and MindFreedom International, with the latter recently forming the International Association for Creative Maladjustment (based on an idea by Martin Luther King!) whose first president, appropriately enough, is Patch Adams, M.D., th...

About two months ago my 89 year old father suffered a stroke and ever since then I’ve been thinking about whether most people understand just what a stroke is. Then someone told me about an inspirational and informational video of a woman named Jill Bolte Taylor describing her own personal experience about having and recovering from a stroke. And even more recently, Dr. Taylor was named #41 in Time Magazine’s fifth annual list of the top 100 most influential people in the world. So it seems timely and appropriate to share her story with readers of Dr. Z’s Medical Report on HealthTalk. Better yet, her video is in the public domain (thanks to TED Conferences) and is included below for you to watch.
As you’ll see, Jill Taylor is a Harvard-trained neuroscientist, meaning that she studi...

IRS tax refund and economic stimulus rebate checks are in the mail - spend them on your health!

Many of you will soon be receiving an IRS income tax refund check, an Economic Stimulus payment check or both. Why not resolve now to take some or all of the money from those government rebate checks and use it to help improve your health? You can help the President’s Economic Stimulus plan and strengthen your health at the same time, just by spending that tax refund check on health-related products and services.
Here’s my top ten list of things on which you could spend your IRS rebate check to improve your health:
1. Smoking cessation classes, kits, products or medications. If you smoke, the best thing you can do to improve your health is to stop. The American Cancer Society has a wealth of information on smoking cessation including aids you can buy.
2. Join a gym or health club, hire...

i had understood the word decimate to mean “to select by lot and kill every tenth person of” until fairly recently, when i’ve heard it used to describe a situation in which everyone has been killed or everything has been destroyed. when i first heard that “the city had been decimated,” i thought to myself, “well, that’s not so bad. only one tenth of it has been destroyed.” but then it occurred to me that the reporter was actually saying that the whole city had been destroyed. wow, those are two totally different things, one-tenth and ten-tenths! so i looked it up in the dictionary, and you know what? it means both!

i’ve noticed that the word interesting is beginning to increasingly creep into the conversations i have with my friends. “that article on metadata is interesting,” or “her new hairstyle is interesting.” when i hear someone else say it i usually ask, “what is it about x that you find interesting?” because without qualification the word is kind of a meaningless space filler. it doesn’t really tell you what the person really thinks. it reminds me of the undergrads i would lead in photography critiques, in which they would try to get away with describing someone’s photo with, “i like it.”

“a couple apples,” or “a couple of apples,” which is the correct one? after some sniffing around i find that both are acceptable.
a thread at linguist-list has a useful discussion on this very topic.
the free dictionary has this usage note:
Although the phrase a couple of has been well established in English since before the Renaissance, modern critics have sometimes maintained that a couple of is too inexact to be appropriate in formal writing. But the inexactitude of a couple of may serve a useful purpose, suggesting that the writer is indifferent to the precise number of items involved. Thus the sentence She lives only a couple of miles away implies not only that the distance is short but that its exact measure is unimportant. This usage should be considered unob...

For a state check go to the computer and enter the name of the state and the words "criminal background check".The article said that background checks can be done through the FBI database also. Hollenberg became a special advocate for people with diabetes after her grandson, Malcolm, was diagnosed with type 1 in 1996 at 2 1/2 years old. Malcolm calls his grandmother 'Grandma Sandy', a most fitting name for her website, which debuted in 2001. This special resource offers free downloads of books and games to teach kids about type 1 diabetes. A family effort, Malcolm's brother Paul pitched in to help invent the games.

Compliance checks, which are required for states to receive federal substance abuse funding, found that 1 in 10 teens could buy cigarettes at convenience stores. A smaller percentage were able to purchase cigarettes at tobacco stores, restaurants, and grocery stores. Teen cashiers were more likely to sell to other teens than older employees. One theory is that the distraction of gas sales causes employees to be less diligent about checking IDs.
