By Gene HealyMy DC Examiner column this week focuses on Barack Obama’s transformation into our National Noodge, nudging, shoving, poking and prodding Americans into healthier lifestyles via the powers of the federal government.
A year ago, the New York Times got all excited about the “new age of regulation” the administration was busy ushering in. The president had elevated “a new breed of regulators”: folks like regulatory czar Cass Sunstein, who wants to “nudge” Americans toward healthier consumption choices, and CDC head Thomas Frieden, who, as NYC health commissioner, proclaimed ”when anyone dies at an early age from a preventable cause in New York City, it’s my fault.”
Today’s column tracks how this killjoy crusade is playing out:

By Walter OlsonI had an op-ed in the Washington Times yesterday on government’s growing participation in public-health scare campaigns demonizing everyday foods that are fattening, salty, or thought to be bad for us in other ways. In particular, I singled out Mayor Michael Bloomberg’s New York City Department of Health, which has followed up one scientifically dubious ad campaign on sweetened soft drinks (“What can we get away with?” asked one official) with an even worse — in fact, grossly misleading and manipulative — attack on salt in processed foods:
It shows a can of soup bursting at the seams with table salt, whole mounds and piles of it. The city’s underlying point is not 100 percent off-base – healthful in most other ways, convention...

By Chris EdwardsWe’ve got an IRS Commissioner who doesn’t even do his own taxes, and is not embarrassed about it. We’ve got complex deductions that nobody understands, including the government, as the Maryland nurse with the MBA found out. We’ve got a Treasury Secretary and other high appointees who apparently cheated on their taxes. And we’ve got the Democrats hell-bent on greatly increasing the power and responsibilities of the overwhelmed IRS with their health care bill.
Now, more than ever, it’s time to scrap the current income tax and put in a flat tax. Or at least we could take a big jump in that direction with a “Simplified Tax,” as discussed in a new National Academies report. Get rid of all almost all deductions, exemptions, and cr...

FDA critics like Steve Nissen and Peter Rost are the candidates of choice in the Pharma Marketing News survey that asked respondents to vote on who they think should be nominated as the next FDA Commissioner. The survey included representatives from various stakeholders, including executives and staffers working within the pharmaceutical industry, agents and vendors to the industry, healthcare professionals, members of the general public, and staffers within government health agencies. It is particularly interesting that former FDA Commissioner David Kessler is almost as popular as Janet Woodcock among pharmaceutical industry respondents.Perhaps it is not surprising that the drug industry favors these “insiders” and not “change agent” outsiders like Nissen, Rost, or Susan Wood, who a...

A coalition of health groups, including some that are backed by the pharmaceutical industry, have joined the heated lobbying battle over the next FDA commish by sending a letter to Health and Human Services Secretary-designate Tom Daschle urging him to pick a person familiar with the industry, The Wall Street Journal reports.
The newly formed FDA Commissioner Coalition is made up of 34 patient and research organizations, most of which receive funding from drugmakers, the paper writes. The coalition’s letter to Daschle didn’t name any candidates but argues the next commissioner should make decisions free from “pressure from elected and appointed officials and from the news media.”

This is no surprise - Andy von Eschenbach signaled awhile ago that he would depart when the next administration entered the White House. But the FDA commish, who has been a lightning rod for criticism that the agency paid inadequate attention to food and drug safety, sent employees a memo yesterday specifying that he will leave on January 20, when President-elect Barack Obama is sworn in.
Unflappable as ever, though, Andy ignored recent setbacks and failures, and instead focused on the positive, such as a new FDA campus in suburban White Oak, Maryland, that will become agency headquarters this week, according to The Wall Street Journal.
“I am extremely proud of the progress we have made together,” Andy wrote to FDA staffers. “Resources are on a dramatic upward trajectory...

BETHESDA, Md -- Yesterday, as FDA Commissioner Andrew von Eschenbach was announcing that he plans to resign effective Jan. 20, 2009, a disgruntled FDA staffer rose abruptly from his seat about 12 feet away, reared his right arm and fired a shoe at the commissioner’s head while shouting: “This is a gift from the entire FDA staff; this is the farewell kiss, you dog!” The incident was captured by CNN cameras (see a frame from the video below).Dr. von Eschenbach deftly ducked and the shoe narrowly missed him. A few seconds later, the un-named staffer tossed his other shoe, again with great force, this time shouting, “This is from the elderly, the poor and those who were harmed by dangerous drugs approved by the FDA!” Again, the shoe sailed over the commissioner’s head. The shoe thro...

A doctor who once denounced Pfizer for holding a marketing event in a pool hall is leading President-elect Barack Obama’s team formally assessing the troubled FDA, boosting his chances of becoming the next FDA commissioner, according to The Wall Street Journal.
Joshua Sharfstein, now head of the Baltimore Health Department, has tangled with the pharmaceutical industry on several occasions and would likely lead the agency to get tougher on drugs, the paper writes, adding that drugmakers might just benefit from his strong support of childhood vaccinations. Just the same, several other candidates are in the running, and no decision appears imminent.
Sharfstein, 39 years old, is a former staffer for Henry Waxman, the California Democrat who recently won the chairmanship of the House Ener...

For the past month, a favorite sport among some Washington insiders and, certainly, the pharmaceutical world has been trying to figure out who will succeed the unflappable Andy von Eschenbach as FDA commissioner. Would it be the FDA’s own Janet Woodcock? Baltimore health commissioner Josh Sharfstein? Duke’s Robert Califf? Harvard’s David Blumenthal? Or maybe Cleveland Clinic’s Steve Nissen?
Now, US Senator Sherrod Brown, an Ohio Democrat, is nominating several candidates for the post and one of them is…. drumroll…. Peter Rost, the former marketing exec who is embroiled in a whistleblower lawsuit with Pfizer (look here) and gained notoriety for stumping in Washington DC - with Brown at his side - in favor of importing lower-cost drugs from Canada.
To date, nearly 250 people have responded to my Who Should Obama Nominate for FDA Commissioner? survey. The results so far show Rost, Wood, Nissen, Woodcock, and Califf as the top 5 contenders.Eighty-six percent (86%) of respondents are from the US and the charts below focus on choices made by these respondents. These are preliminary results -- I intend to keep the survey going until someone is nominated. If you haven't yet voted, I hope you will take a couple of minutes to do it now and include what you think should be at the TOP of the new commissioner's agenda.Peter Rost -- who has made a reputation as whistle blower, muckraker, and Pfizer nemesis -- holds the lead among all US respondents, 31% and 28% of whom are very and somewhat supportive of the pharma industry, respectively.
Peter Rost Gets Serious About Becoming Obama's Choice for the New FDA Commissioner

Today I noticed that Peter Rost -- former Pfizer Marketing VP, turned drug industry whistle blower, author, and blogger -- changed the name of his blog (again!) to PETER ROST FOR FDA COMMISSIONER.It all started when I reported on Pharma Marketing Blog that FDA Intern -- Strange visitor from an Ivy League school who came to FDA with powers and ability far beyond those of Janet Woodcock or even FDA commish Andy von Eschenbach! -- announced her endorsement of Peter Rost as president-elect Obama's nominee choice for the new FDA Commissioner (see "FDA Intern Supports Peter Rost for New FDA Commish!").Peter himself had re-published on his blog a 2004 press release in which Rahm Emanuel -- Obama's new Chief of Staff -- expressed a glowing opinion of Rost (see "Emanuel Statement: Importation Press...

FDA Critics Lead the Pack of Contenders for New FDA Commissioner According to Poll!

In a surprising turn, three outspoken critics of the FDA are in the lead in my "Who Should Obama Nominate for FDA Commissioner?" survey! In order, the 5 leaders as of today are:Peter RostSteve NissenSusan WoodJanet Woodcock and Robert Califf (tied for fourth place)Peter Rost, Steve Nissen, and Susan Wood have all been very critical of the pharmaceutical industry in general and the FDA in particular. Rost is a drug industry whistle blower; Nissen is a cardiologist who has often tangled with FDA's handling of drug safety information; Susan Wood worked inside the FDA until she resigned in protest (see more details about these and other contenders within the survey site). It seems that the same sentiment that propelled Barack Obama into the presidency -- ie, "change we can believe in" -- is als...

Susan Wood: "The One to Take the Lead" of the FDA

Barack Obama won me over with his slogan "Change You Can Believe In." One change that he needs to make as the new president is the FDA Commissioner. A change I would believe in is Susan Wood in that position.Who is Susan Wood?In her own words she is "The One To Take the Lead." This was the title of her January, 2008, blog endorsement of Senator Hilary Clinton for the Democratic party's presidential nominee (see below). I don't hold that against her, though.I urge president-elect Obama to do what I am sure Hilary Clinton would have done if she were president: nominate Susan Wood as the new FDA Commissioner!Obviously, Woods' nomination would send a message to Clinton and her supporters -- not to mention the foes of abortion -- about where Obama stands on women's rights. But, it's not just ab...

Vote for New FDA Commissioner: Let Obama Know

Who Should Obama Nominate for FDA Commissioner? It seems like everyone in the Pharma Blogosphere and the press is recommending who president-elect Barack Obama should nominate -- when he becomes president -- as the new FDA Commissioner to replace Dr. Andrew von Eschenbach (see here for comments from the pundits and press). The following list presents the major contenders the pundits have identified. * Robert Califf, vice chancellor for clinical research and professor of medicine in the Division of Cardiology at Duke. * Dora Hughes, Health Policy Advisor to Senator Barack Obama. * David Kessler, former FDA Commissioner. * Steve Nissen, cardiologist at Cleveland Clinic. * Mary Pendergast, industry consultant who was a former associate FDA Commissioner under David Kessler. ...

Five Rules Of Thumb About A New FDA Commish

The ever-insightful RPM Report has a handy list of reminders as we ponder who - just who - might succeed Andy von Eschenbach as the next FDA commissioner. This is the sort of cheat sheet you may have come up with yourself, but you didn’t. So here it is…
1 - The FDA May Be Your Top Priority, But It’s Not Obama’s: There is a financial crisis under way, remember? “In this climate,” RPM writes, “priority goes to economic posts.” You know, the Securities and Exchange Commission and the Treasury Secretary. Besides, the Centers for Medicare & Medicaid Services is usually filled first. And as a post confirmed by the Senate, naming a new commish is guaranteed to take months. So let’s see, about 12 months from now…
2 - It’s Not Necessarily O...

Pharma Prefers Woodcock As Next FDA Commish

That’s the buzz as FDA commish Andy von Eschenbach prepares to resign prior to Barack Obama taking office in January. Woodcock, who has 22 years under her belt as an FDA insider, is apparently the top industry choice to succeed him, according to Bloomberg News, citing unnamed sources.
Whether this will fly is, of course, unclear. A whole bunch of possibilities are being tossed about this week, including Cleveland Clinic cardiologist and Obama adviser Steve Nissen (see our reader’s poll), who has support among consumer advocacy types. Others include Baltimore health commissioner Josh Sharfstein, Duke’s Robert Califf and Harvard’s David Blumenthal (look here for more).
Woodcock, 60, would appear to represent a safe choice, at least for pharma, which apparently would ...

Should Steve Nissen Be The Next FDA Commish?

Is Nissen a love-him-or-hate-him kind of candidate? Is he too closely tied to some drugmakers, given that the Cleveland Clinic cardiologist runs clinical trials? Or is he too critical of pharma to weigh industry’s interests? What do you think? Barack Obama will nominate someone to succeed Andy von Eschenbach. Here’s a chance to deliberate…

Mitchell, 73, said in a statement that he expects his treatment will not interfere with his investigation that began in March 2006 when he was appointed by MLB Commissioner Bud Selig to interview hundreds of people and review thousands of documents. "The investigation, which is in its final phases, will be completed in the coming months and neither the...
