            <description>By Ilya ShapiroThe federal government is currently engaged in a misguided attempt to use a noneconomic statute &amp;#8212; the Endangered Species Act &amp;#8212; to regulate under its Commerce Clause authority a noneconomic activity, the potential “take” of the noncommercial, wholly intrastate delta smelt.  Acting under this purported authority, the U.S. Fish and Wildlife Service issued an opinion in 2008 that requires a reduction of critical water deliveries in California for the alleged benefit of the threatened delta smelt species.  The delta smelt-based water cutbacks have resulted in substantial hardship to farmers and other water users in Southern California and the San Joaquin Valley.

            <description>It was reported on TIME magazine that a Berlin hematologist, Gero Huetter, has claimed that he had cured an HIV infection in a 42-year old man through bone marrow transplant he had performed at Berlin&amp;#8217;s Charité hospital two years ago.  The patient had been suffering from advance stage leukemia and HIV and, after transplant of bone marrow from a donor naturally resistant to HIV, he seemed to be &amp;#8220;virus free&amp;#8221;.

Delta wants to collect 10,000 photos of people smiling. That&amp;#8217;s it. If you have a picture of yourself smiling, submit it. Why? Well, if Delta reaches their goal of receiving 10,000 photos of people smiling, they will donate $10,000 to the National Head Start Program, an organization that helps to develop vulnerable and underprivileged children. This is a good cause and it only takes a couple of seconds to submit a photo. So, submit one if you can.

            <description>The Vermont Human Rights Commission ruled today that Freedom Airlines discriminated against nursing mother Emily Gillette when a flight attendant asked Gillette to cover up while breastfeeding. The parties now have a six-month period in which to attempt to negotiate a settlement. If a settlement is not reached, the Commission could file a civil suit against Freedom Airlines. Gillette&amp;#8217;s lawyer Beth Boepple has been quoted as saying: 
What the Human Rights Commission does with it and how they decide to fashion a remedy once we get past the next stage of the process&amp;#8211; which is a six-month period of trying to negotiate a settlement &amp;#8212; could in fact be precedent setting.

According to the Burlington Free Press, the Commission will review the findings of its investigator, who found reasonable grounds that Freedom discriminated against Gillette. The hearing is set to take place on Thursday, March 27, 2008, and it is closed to the public. While Gillette said she is not required to attend, she traveled to Vermont anyway.
