FTC: NY Bill Nixing Mail Order Rx Hurts Consumers

A bill in New York to prohibit health insurers from requiring their customers use mail-order pharmacies was criticized by the Federal Trade Commission as a well-intentioned effort that, nonetheless, could have an anti-competitive outcome, according to a letter written by the agency to one of the sponsors of the legislation. The bill has passed both the state senate and assembly, and awaits a signature from New York Governor Andrew Cuomo.
In explaining its position, the FTC acknowledged that the bill (which you can read here) was designed to increase consumer choice and limit the ability of pharmacy benefit managers, or PBMs, from penalizing consumers who do not purchase their meds from mail-order pharmacies. You may recall that the largest PBMs, including CVS/Caremark, Express Scripts and ...

By Michael D. TannerMassachusetts Governor Mitt Romney announces today that he will be a candidate for president. His announcement is expected to tout his business experience and to portray him as the candidate best able to deal with the country’s economic problems. But one thing you are not likely to hear him talk about is his Massachusetts health plan, Romneycare.
Of course, Romney has already tried to put this issue away with a speech in Detroit last month, and he would probably be happy to never talk about it again. But if Romney really believes he can hide from the Romneycare fallout, he is badly mistaken.
Cato scholars have issued several reports detailing the many failings of Romneycare. Those studies can be found here , here , here and here for instance.

By Randal O'TooleTo sell his high-speed rail program, President Obama desperately needed a success story—a high-speed train operating during his administration that would awe the public and lead to a national demand for more such lines. That success story was going to be Florida’s Orlando-to-Tampa line, the only true high-speed route (as opposed to speeding up existing trains by 3 to 5 mph) that could have been completed during Obama’s term in office (assuming he is re-elected).
Anticipating that success, the administration drafted a proposal to use federal gasoline taxes and a “new energy tax” to fund $53 billion for more high-speed rail lines over the next six years. (The proposal also included $250 billion for highways, $120 billion for urban transit, $27 billi...

By Daniel J. MitchellThe showdown in Wisconsin has generated competing claims about whether state and local government bureaucrats are paid too much or paid too little compared to their private sector counterparts.
The data on total compensation clearly show a big advantage for state and local bureaucrats, largely because of lavish benefits (which is the problem that Governor Walker in Wisconsin is trying to fix). But the government unions argue that any advantage they receive disappears after the data is adjusted for factors such as education.
This is a fair point, so we need to find some objective measure that neutralizes all the possible differences. Fortunately, the Bureau of Labor Statistics has a Job Openings and Labor Turnover Survey, and this "JOLTS" data includes a measure of ho...

By Mark A. CalabriaTuesday the Senate Banking Committee meets for the second time to consider the nomination of Peter Diamond to a seat on the Federal Reserve’s Board of Governors. Since Professor Diamond was first nominated, he has been awarded the Nobel prize in economics.
Putting aside his academic qualifications, and his misguided views on Social Security, Professor Diamond is not qualified to be a Fed governor for one very simple reason: he is from a Federal Reserve district that already has representation on the Fed. Paragraph 10-1 of the Federal Reserve Act requires that:
In selecting the members of the Board, not more than one of whom shall be selected from any one Federal Reserve district, the President shall have due regard to a fair representation of the financial, agri...

By Chris EdwardsWe released Cato’s report card on the fiscal policies of the governors today. We calculated data on the taxing and spending habits of 45 of the nation’s 50 governors, between 2008 to August 2010.
The governors are scored from 0 to 100 on seven separate taxing and spending variables. The scores are aggregated and converted to letter grades, A to F.
Four governors earned an “A” this year: Tim Pawlenty of Minnesota, Bobby Jindal of Louisiana, Mark Sanford of South Carolina, and Joe Manchin of West Virginia. You can read the report to find out what these governors did right from our limited-government point of view.
As it turns out, the residents of these four states seem to like the fiscal stance of their winning governors, who favor tax cuts and spending restraint...

Washington State Considers Privatizing the System

By Andrew J. CoulsonWashington state legislators will reportedly have to cut billions from the budget when they reconvene next session, and governor Christine Gregoire has commissioned a privatization study to see if taking the big step makes economic sense. Washington’s public schools spend about $13 billion annually (around $13,000/pupil — see Table 8 here), so increasing the system’s efficiency has the potential to solve the state’s budget crisis….
…which is why many Washington taxpayers will be disappointed to learn that the governor’s privatization study is only for the ferry system, not the schools. Since ferry-travelers pick up about two thirds of the system’s operating costs, its total burden on taxpayers is 26 times smaller than th...

By Chris MoodyHe did it again: Florida governor and senatorial candidate Charlie Crist cited Cato’s 2008 Governors’ Report Card as evidence of his fiscal conservative credentials, this time in a Fox News Sunday debate with his primary opponent Marco Rubio.
Trouble is, the report card’s author, Chris Edwards, has gone on the record again and again explaining how Crist has fallen hard off the fiscal responsibility wagon since the report was released two years ago.
The Florida media has publicized Edwards’ correction of the record numerous times since Crist began citing the Cato rating in his political ads. It is difficult to believe that Crist can be unaware of that.
Here’s Edwards in October 2009:
Since I wrote the report in mid-2008, the governor seems to have fallen off ...

By Mark A. CalabriaDespite still defending the Fed’s bailouts, Fed Governor Kevin Warsh gave a speech this morning offering a few insights about reforming our financial system that seem to be lost on both Obama and Bernanke.
A few highlights:
The mortgage finance system is owed far stricter scrutiny to gather a fuller appreciation of the causes of the crisis. The government-sponsored enterprises (GSEs), Fannie Mae and Freddie Mac, for example, were given license and direction to take excessive risks.
One has to hope that both Bernanke and Obama are listening. The silence of the Obama administration on fixing Fannie and Freddie is nothing short of shocking and irresponsible. Any commitment to real reform has to include the GSEs.
Granting new powers to resolve failing firms in th...

By Neal McCluskeyYesterday, I wrote about President Obama’s proposal to extend the Race to the Top program, this time letting school districts completely bypass state governments and apply directly to the feds for funding. I pointed out that the proposal was one among several troubling signs that Obama intends to put Washington fully — and, of course, unconstitutionally — in charge of American education. At the time, I didn’t realize how right I was.

I took this picture a couple of years ago during a trip to Iowa. This is the old Clarinda Asylum for the Insane. The name was changed for obvious reasons a long time ago to the Clarinda Treatment Complex. I grew up in Iowa, so let me tell you a few things about my home state. Among other things, Iowans grow corn, raise hogs, and sometimes elect people to the Iowa State House who need a little schooling about mental illness and the needs of the mentally ill.

Iowa currently has four state hospitals for the mentally ill. Now that number is being cut down to three. Iowa State Legislators, who have no clue about what they’re doing, ordered the head of the Department of Human Services, Charles Krogmeier, to shut down one of the state’s mental hospitals. The Clarinda facility and three ...

Florida’s airwaves are alive with the sound of Governor Charlie Crist’s radio advertisement trumpeting his grade of “A” on Cato’s “Fiscal Policy Report Card on America’s Governors.”
I am pleased that Gov. Crist values Cato’s ratings because we work hard to make them accurate and nonpartisan. But the radio ad is making many fiscally conservative Floridians scratch their heads because of the governor’s recent policy actions.
The governor earned his Cato grade in last year’s report mainly because of his large property tax cuts and moderate spending approach. The grade was based purely on quantitative data on revenues, general fund spending, and tax rate changes.
However, since I wrote the report in mid-2008, the governor seems to have fallen off the fisca...

Mervyn King, governor of the Bank of England, has shocked the staid world of British banking by raising the possibility of breaking up the UKs big banks. Mr. King is no socialist, but a worried banking regulator. He is worried about “the sheer creative imagination of of the financial sector to think up new ways of taking risk.”
Around the world, regulators and finance ministers are hoping that banks will grow their way out of their current mess. To do so, however, banks will in fact need to seek new ways of taking on risk. It is called going for broke: the upside goes to stockholders and managers, and the downside to taxpayers. Mr. King knows that it is a “delusion” that regulators can control bank risk-taking.
Whether one agrees with his solution, at least he recog...

In a disappointing and short-sighted move, California Governor Arnold Schwarzenegger recently vetoed two breastfeeding bills. One was the bill I took the time to ask my state senators to support — SB 257 the Pavley-Employee Notification/Lactation Accommodation that would have required state entities to inform pregnant employees about the existing California law that requires workplace lactation accommodation. California Governor Arnold Schwarzenegger, Image: Zuma PressGovernor Schwarzenegger believed that there was not adequate evidence that mothers are not aware of their right to workplace lactation accommodation. However, the California WIC Association sponsored the bill in the first place because it found that state agencies do not always advise pregnant women of their rights and ...

With Gov. Deval Patrick’s appointment of longtime Kennedy courtier Paul Kirk to Sen. Edward M. Kennedy’s seat in the U.S. Senate, there are now at least three close aides holding on to Senate seats while their states go through the formality of an election. The governor of Delaware appointed Joe Biden’s longtime friend and former chief of staff to fill the rest of his term in the Senate. Can you name him? It is generally thought that he is obligingly holding on to the seat until Biden’s son Beau gets back from National Guard service and is able to run to succeed his father. And in Florida, Gov. Charlie Crist named his former chief of staff to fill the seat of retiring Sen. Mel Martinez until the 2010 election in which Crist is running for the seat. There are more ...

In re-appointing Bernanke to another four year term as Fed chairman, President Obama completes his embrace of bailouts, easy money and deficits as the defining characteristics of his economic agenda.
Bernanke, along with Secretary Geithner (then New York Fed president) were the prime movers behind the bailouts of AIG and Bear Stearns. Rather than “saving capitalism,” these bailouts only spread panic at considerable cost to the taxpayer. As evidenced in his “financial reform” proposal, Obama does not see bailouts as the problem, but instead believes an expanded Fed is the solution to all that is wrong with the financial sector. Bernanke also played a central role as the Fed governor most in favor of easy money in the aftermath of the dot-com bubble — a policy t...

Last week, the governor of Arizona signed H.B. 2426, which bars the state from implementing the “enhanced” drivers license (EDL) program.
If the federal REAL ID revival bill (PASS ID) becomes law, it will give congressional approval to EDLs, which up to now have been simply a creation of the federal security and state driver licensing bureaucracies.
As governor of Arizona, the current Secretary of Homeland Security signed a memorandum of understanding with the DHS to implement EDLs, and she backs PASS ID even though she signed an anti-REAL ID bill as governor. As I said before, Secretary Napolitano seems to be taking the national ID tar baby in a loving embrace. (Source: Cato-at-liberty)

As I have argued elsewhere, Bernanke’s record as both a Fed governor and Chair suggest we be better off with a new Fed Chair come January 2010, when Bernanke’s term as Chair expires. Outside of those who believe the bailouts have saved capitalism, two very reasonable arguments are put forth for keeping Bernanke at the helm: 1) in a time of crisis, the markets need certainty and dislike change; and 2) the alternatives, such as Larry Summers, would be worse. Both these points have real merit, however I believe in both cases the pros of change outweigh the cons of staying the course with Bernanke. I will save the “certainty” debate for another time, for now, let’s ask ourselves: Would Summers really be any worse than Bernanke?

While politicians and bureaucrats generally are on the same side, there are occasional conflicts. For instance, if politicians want to limit the growth of an agency’s budget (an infrequent impulse, to be sure), the bureaucrats get upset and sometimes they fight back. A common tactic is to try and generate public opposition by leaking to the press that they will have to curtail something that taxpayers actually value. This is known as the Washington Monument Syndrome, which is a reference to the National Park Service’s petulant decision about 40 years ago to close national monuments two days per week because of a very small budget reduction. A very perverse example of the Washington Monument Syndrome just took place in Massachusetts, where officials at the New England Zoo t...

Recent weeks have seen a swirl of speculation over whether President Obama will or will not re-appoint Ben Bernanke to the Chairmanship of the Federal Reserve Board, when his current term as Chair expires in January 2010. Almost all of the debate has centered on his actions as Chairman. This narrow focus misses an important piece: his actions, and words, as a Fed governor during the build-up of the housing bubble.
What should have been Bernanke’s greatest strength as a Fed governor and later chair, his understanding of monetary theory and his knowledge of the Great Depression, has ended up being a weakness. While correct in his analysis of the role of “debt deflation” — where the deflation increases the real burden of debts and correspondingly weakens the balance s...

Obama Considering Another Round of Stimulus
With unemployment continuing to climb and the economy struggling along, some lawmakers and pundits are raising the possibility of a second stimulus package at some point in the future. The Cato Institute was strongly opposed to the $787 billion package passed earlier this year, and would oppose additional stimulus packages on the same grounds.
“Once government expands beyond the level of providing core public goods such as the rule of law, there tends to be an inverse relationship between the size of government and economic growth,” argues Cato scholar Daniel J. Mitchell. “Doing more of a bad thing is not a recipe for growth.”
Mitchell narrated a video in January that punctures the myth that bigger government “stimulate...

Research proves that a healthy employee costs the company less money. How to encourage employers to create a healthy work environment? By rewarding and recognizing them.

That’s what Wisconsin Governor Jim Doyle does each year with his Worksite Wellness Awards. Employers can send in applications that consider health education and screening, tobacco use, and other programs the company may have in place.
This year’s gold winners were:
•	Saint Joseph’s Hospital (Marshfield)
•	Creation Technologies Wisconsin Inc. (Oak Creek)
•	Gundersen Lutheran Health System (La Crosse)
•	Memorial Health Center (Medford)
•	Polaris Industries, Inc. (Osceola)
•	QuadGraphics (Sussex)

Jonathan Martin of The Politico discusses the unexpected and still unexplained absence of South Carolina Governor Mark Sanford and why it may impact Sanford’s alleged presidential aspirations. We excerpt the piece below.
* * *
South Carolina GOP Gov. Mark Sanford’s disappearing act is reviving an often-whispered, if rarely written, question about presidential hopefuls: Just how strange is too strange?
It takes a unique person to run for the White House, but the dividing line between endearingly quirky and just downright odd can often separate winners from losers.
Sanford’s solo stroll on the Appalachian Trail falls short of the character questions raised by changing your name and fudging your age (Gary Hart) or accusing an incumbent president’s campaign of trying to disrupt y...

There’s an old Yiddish saying that, “If my bubba had wheels she’d be a trolley.” So goes the logic of the Obama administration in their paper released yesterday, “The Economic Case for Health Care Reform.” Their claim is that reducing health care costs would help the economy. Yes, if health care costs were reduced it would likely help the economy, though we should remember that the health care industry is part of the economy.
There is nothing in Obamacare, however, that will reduce costs. In fact, expanding coverage may cause costs to rise. One study by MIT’s Amy Finkelstein suggests that the prevalence of insurance itself has roughly doubled the cost of health care. So, if Obama succeeds in expanding insurance coverage, it’s very likely to increase the cost...

Over the past few days, it seems like every major state newspaper ran a story on the state’s governor signing onto the Common Core State Standards Initiative, an effort to establish national standards in mathematics and reading curricula. The only holdouts are Alaska, Texas, Missouri, and South Carolina.
I should probably be more worried, because national standards are a terrible idea.
First, there is nothing inherently better about having a single standard agreed to by numerous states than having individual states set standards for themselves. Either way, politicians – people inherently most responsive to mobilized, highly motivated public school employees who want as little meaningful accountability as possible – will be setting the standards, and the standards will therefore eithe...

Well, that didn't work out: This year alone, we are about $17 billion in the hole and counting. That aside, Schwarzenneger first violated his fiscal responsibility raison d' etre for running for governor by supporting California's going $6 billion deeper into debt--at a time when our streets weren't being repaired and our hospitals were cracking under fiscal burdens--to pay the private sector and their university business partners to conduct human cloning and ESCR. This was back when he was really popular. Before his support, Proposition 71 was under 50% in the polls. Afterwards, it soared to victory. This year, when the CIRM paid $270 million this year to buy the most expensive buildi...

Regular readers of this blog will know that I’ve previously written about skin cancer, skin cancer prevention and the skin cancer-inducing risks of indoor tanning.
So it will come as no surprise that I was troubled to learn that Alaska Governor and Republican vice presidential candidate Sarah Palin had installed a tanning bed in the Governor’s mansion shortly after taking office in early 2007 and that this was being widely reported in the media. My concerns were that Governor Palin’s apparent endorsement of indoor tanning might lead some people to believe that it’s an okay thing to do.
The good news is that Governor Palin apparently knows better than to use an indoor tanning bed. On May 4, 2007, she issued an official statement proclaiming May 2007 as “Skin Ca...

Everything is Oprah!Apparently, Governor Sarah Palin's daughter is pregnant and will marry the father. From the story:"We have been blessed with five wonderful children who we love with all our heart and mean everything to us," the Palins' statement said. "Our beautiful daughter Bristol came to us with news that as parents we knew would make her grow up faster than we had ever planned. As Bristol faces the responsibilities of adulthood, she knows she has our unconditional love and support," the Palins said.I don't know how this will impact the campaign, if at all. But look for there to be a sharp contrast drawn between the Palin family's loving acceptance of the new child, with Senator Barack Obama's statement that he wouldn't want his daughters "punished with a baby" if they made a "mista...

This just came over the Internet machine from Ralph Toddre who (now) used to be the Chairman, Nevada Autism Task Force and Founder, Autism Coalition of Nevada. Nevada’s budget problems are well known and the mismanagement of the nations’ worst Governor is a sad reality.

Hello All,
I felt it was important for me to pass on this information out of the Governor’s office.
Apparently the Governor’s office has decided that the recommendations put forth in the Nevada Autism Task Force Report, “will cost the state too much money”, and therefore will not be acted upon. The Task Force has been dissolved, and no re-appointments will be made. A highly placed source at the Governors office said, “that decision came from the very top.”

Today Connecticut Governor M. Jodi Rell signed House Bill 5696, which requires insurance companies to cover physical, speech and occupational therapies for autism, if their policies cover these treatments for other conditions, and also House Bill 5590, which calls for a statewide plan to teach autistic children. In Virginia, parents are seeking to get House Bill 83—which would mandate insurance coverage for autism—passed, according to WTOP News.
Said Gov. Rell in Norwalk Plus
“As parents we take great joy in our children’s ‘firsts.’ Their first smile. Their first steps. Their first words…..We are also the first to sense a problem. This new law open doors to more treatment – and sooner.”

“There is a silent health crisis in America… it’s that fact that, on average, American men live sicker and die younger than American women.”
- Dr. David Gremillion
Men’s Health Network
“Recognizing and preventing men’s health problems is not just a man’s issue. Because of its impact on wives, mothers, daughters, and sisters, men’s health is truly a family issue.”

Governor, New Mexico
Since 1994, Men’s Health Week has been celebrated each year as the week leading up to and including Father’s Day. The purpose of Men’s Health Week is to heighten the awareness of preventable health problems and encourage early detection and treatment of disease among men and boys.

Sometimes things just happen.I'm sure that the New York Democratic Party never envisioned Governor Eliot Spitzer resigning, which means David Paterson (the current Lieutenant Governor) takes over as the Governor of New York State for the next three years. There are probably scores of politicians in New York who now regret not pursuing the post of Lt. Governor. And there are probably a lot of New Yorkers that will be surprised to learn that their new Governor is not only Black, but legally blind. The position of Lieutenant Governor in New York has always been a somewhat weak one, and one that is not eagerly sought after. And no one ever envisioned the youthful and energetic Spitzer would ever need to be replaced. And when the job is playing second fiddle to one with an ego as large as Spitze...

There’s really something interesting about human nature that makes us want to analyze a famous person’s downfall, despite knowing virtually nothing about a person’s personal life, psyche, or family background.
So the psychology pundits were out in full force today to give their two cents as to how a governor of one of the most powerful states in the U.S., New York governor Eliot Spitzer, could be caught in a prostitution sting:

Why do otherwise smart, successful people do such risky things? […] In such situations, does the risky behavior precede the powerful job? Or does something about being in power cause the behavior?
Many speculated that it was a combination of the two. “We’re all human,” said Leon Hoffman, a psychoanalyst in New York. &#8...

I'm sad because I realize my first baby boy is truly on his way to growing up. School has him now; I don't. I can't help but predict he will need me less and less as he takes on the world in his own independent way. This makes me happy too. I am eager to see how he fares on his own, how he develops, grows, and soars. And I must admit, I am pretty thrilled about having five mornings per week all to myself -- my youngest little boy begins school today too.On Friday, we went to six-year-old Joey's elementary school for a meet-the-teacher event. Joey was right at home. He sat at his assigned desk, did a little drawing, and snuggled up in a pile of pillows in the reading corner. I f...

Hager has diabetes and was born with one kidney. Her brother died from diabetes complications and kidney failure. Two of her four children were also born with one kidney and developed diabetes. Rough stuff.
This past Friday, Wisconsin's Governor Jim Doyle honored Hager with the Gift of Life medal of honor for donating her daughter Kelly's two kidneys after she died last year. Kelly was profoundly mentally disabled, and Hager is confident Kelly is livin...

First, though, is the long, hard, down and dirty campaign slog in which each candidate has to do the impossible - try and be all things to all people. One thing we can except is that they all devote a little time to addressing diabetes. Specifically, finding a cure for type 1 diabetes and strategies for containing the unprecedented spread of type 2 diabetes. The type 2 "epidemic" (as it is sometimes called) is all the more serious because of the strain it is adding to the US healthcare system, a system already failing to meet the needs of many Americans.During Monday night's CNN/YouTube debate, the c...

Filed under: Drug, Politics, Daily newsConnecticut Governor M. Jodi Rell is a cancer survivor. And so she knows the pain and heartbreak associated with the disease. Still, she vetoed a bill that would have allowed people with serious illnesses to use marijuana for medicinal purposes. It's just too problematic and sends mixed messages to children, Rell said in a statement last Tuesday. The decision was a struggle for the Republican Rell, who was diagnosed with breast cancer in 2004 and underwent a mastectomy just after taking office. Had she not vetoed the bill, those older than 18 with medical conditions such as cancer, multiple sclerosis, and AIDS would have been permitted to grow and use medical marijuana plants with written permission from a doctor and after registering with the state. ...
