A class action law suit alleging that Bayer HealthCare Pharmaceuticals discriminated against female employees has now been expanded to include female sales reps and all women in the Bayer HealthCare Consumer Care unit, two groups of employees who were not originally part of a discrimination complaint filed two months ago
The initial lawsuit, filed by six current and former Bayer employees, charges a pattern of discrimination in pay, promotions, and the treatment of pregnant women and mothers. An amended complaint filed yesterday says sales reps were paid less but not promoted as often as men in similar jobs, while women in consumer care were sexually harassed by execs but the drugmaker ignored the problem.
Such charges have emerged in many workplaces, but recently allegations of sex discr...

This article traces the development of racial harassment jurisprudence, explaining the development of the traditional model, which does not recognize subtle bias. It concludes with an analysis of an alternative jurisprudential model that “sees” subtle racism.

Another day, another decision about retaliation in the workplace. This time, the conflict involves Novo Nordisk and Vivian Garriga, who joined the drugmaker as a diabetes sales rep in Florida in April 2001. She filed suit after being fired in September 2007, which she alleged in her lawsuit was in retaliation for complaining about her new supervisor’s sexual harassment. A federal district court dismissed her suit, however, and a federal appeals court has now upheld that decision, even while describing her former manager as “boorish.”
Here’s the story: Garriga was assigned to a new supervisor in March 2007 named Brian Taylor, who she alleged soon began a pattern of offensive behavior. As an example, Taylor asked everyone at his first district-wide staff meeting in ea...

A federal appeals court has reinstated a lawsuit brought by a Bristol-Myers Squibb scientist who claims he was fired for sticking up for a subordinate who complained that she suffered sexual harassment by another scientist in her group. The lawsuit was filed in 2004 by Luis Collazo, who worked as a senior process scientist in the drugmaker’s Barceloneta, Puerto Rico, plant, but was fired in February 2003, just two weeks after he pressed human resources to address harassment claimed by Diana Hiraldo.
A lower court dismissed the lawsuit after agreeing with Bristol-Myers that Collazo, who maintained he acted in connection with his supervisory responsibilities, was not protected under the Federal Labor Standards Act, because he “stepped outside” his normal role and took acti...

After resigning her position, a female physician in North Carolina brought a claim of sexual harassment against her former employer, the physician-owner of a medical clinic. Initially the court ruled against her claim, stating that it was “not uncommon in a medical setting to use off-color jokes to “ease the tension.”
The 4th U.S. Circuit Court of Appeals reversed the lower court’s decision, refusing to accept the argument that because a medical setting deals with human anatomy on a regular basis, it is somehow “liberated from professional norms.”

Every day, it seems, a news story tells us about a dentist or dental professional who has molested a patient during a dental appointment. The nature of dentistry (and medicine) is such that we are in a prime situation to (a) sexually harass and (b) be accused of sexual harassment. Sometimes, though, allegations of sexual harassment (not physical contact) result from how a patient perceives a dentist or dental professional.
Mitchell Karp, MSOD, tells us in his article at www.DentalOfficeMag.com, that dentists are considered powerful by patients, and because of this, patients may not feel confident telling their dentist when they feel uncomfortable.
Karp’s article, “How to avoid allegation of sexual harassment and/or discrimination: Five things you need to know,” recommends not making ...

A Bill that I hope will become law in Minnesota and an example for the nation is moving through the Legislature.

StarTribune.com

"The bill would prohibit "harassment, bullying, intimidation and violence" based on a student's personal characteristics such as race, sexual orientation or religion.

It would, in effect, "simply expand the categories of people that schools already cover with their anti-bullying policies," according to OutFront Minnesota, one of the organizations pushing for its adoption.

Education Minnesota, the state's teachers union, is the most prominent of several other groups backing the bill."

Bullying has been the scourge of childhood relationships inside and outside of schools. It has done tremendous damage to developing children at a highly se...

That’s the claim made in a lawsuit filed by Carolyn Gleason, a former rep who visited hospitals and other big medical institutions in northern Florida to sell Mycamine, an anti-fungal med that Roche co-promotes with Astellas Pharma. The trouble began, according to the lawsuit, when a regional manager wanted to boost declining sales by relying, in part, on off-label promotions.
In her lawsuit, Gleason charges she was sexually harassed and, eventually, fired because she refused to follow orders to market the drug for “all purposes,” such as telling docs the drug could be used in lower-cost, 100mg doses to treat candidemia. The FDA, though, had not approved Mycamine for that use or dosage. As an example, she cites a June 2007 club luncheon at which a presentation was being m...

Lesbians and gay men are frequent subjects for modern news, politics, and court opinions. From marriage for same-sex couples to Congressional hearings on the military’s “Don’t ask, don’t tell” regulation, decision-makers are setting policy based on their ideas about how gay people are and how they fit into society. We ordinarily think of lesbians and gay men as predominantly childless, urban residents of cities like San Francisco, New York, Chicago, or Los Angeles or as inhabita...

If you live in the small village of Nachu in Kenya, watch out, because a group of approximately 300 marauding monkeys is out to steal your food, sexually harass your women and attack and kill your livestock! In a truly amazing incidence of interspecies communication, a group of vervet monkeys, Cercopithecus aethiops, is using sexual harassment to intimidate women and children, who are responsible for growing maize, potatoes, beans and other crops for their farming community, causing them to lose their main food supply so they now are dependent upon famine relief to survive.
