By Tim LynchHappy Birthday to my friend and Cato senior fellow Nat Hentoff. He’s 86, but he continues to crank out columns and books on everything from censorship, torture, and the Fourth Amendment’s ban on unreasonable searches, to his passionate love of jazz.
He sat down for a taped interview last month where he offered his views on current threats to free speech and his personal encounters with John Yoo and, way back in the 1950s, with Che Guevara.
Check out his books here.

The day started just like any other day. I slowly dragged my tired body out of the bed, started complaining and began the process of getting ready for work. I had about 2 full hours of sleep due to the new born baby that was sharing a room with my wife and I in our one bedroom apartment. After drinking a full pot of coffee, which burned all taste buds from my tongue, I fired up my piece of crap car and began the journey to work.
I can remember it like yesterday. It was a beautiful day. The sun was shining so brightly that even the rusted spots on my automobile had a marvelous glow as the rays kissed the surface. The temperature was immaculate and I was in the perfect place mentally. I was a proud papa and the sole provider for my family. If there was a spot on the top of the world I was th...

I'm tired of randos coming to my website and submitting bullshit comments to various posts. I've got better things to do than delete 3-5 comments per day calling me an asshole, a meany head, or questioning my professionalism/ethics (and then banning the user)...as if you reading a vague story about a drug seeker / drug shopper compromises THEIR privacy. As if ANYONE reading these stories can find out what state I'm even in -- much less a patient's name. That's just not possible. Considering that I'm not a complete idiot, I change facts, details, and other things to keep the backbone of the story without making it so obvious as to the subject and subject matter. The person fingered in the story wouldn't even know they are the subject matter in 9 of 10 posts.
I get talked to like I'm a pie...

Attention FOOLS:
If you find yourself banned from my website, please grow a brain cell before coming back. Understand that I ban people for being a dickhead, spamming, or being a dickhead. Also, understand that I don't ban single IPs, I usually ban entire subnets. Why? Because if you reboot your PC, you usually get a new IP address a few numbers off. I don't want you back -- because your are a dickhead.
Now, I understand that it's very easy to evade a ban -- I won't explain how, but it doesn't take a rocket scientist.
If you happen to share a subnet with a dickhead, I can accept you being pissed at my forceful deprivation of me from you. Coming at me with a stupid comment at a spoofed IP address doesn't help you -- and it doesn't help me help you.
You’re uh.. banning people now? It seems...

By Ilya ShapiroI’ve resisted commenting on Snyder v. Phelps, the “funeral protest case,” because, as the old saying goes, hard cases make bad law. And in this instance, really weird and repugnant speech makes for a lot of sound and fury signifying very little.
Still, the bizarre and inflammatory facts of the case — protestors show up at soldiers’ funerals to make the point that these deaths are God’s retribution for America’s tolerance of homosexuality — have gained plenty of media interest, particularly during this relatively uneventful term at the Supreme Court. So I have commented a few times on the radio and yesterday attended the oral argument, the transcript of which you can read here and audio for which should be released on t...

Some of you reading from outside of Tennessee have probably seen that we have our own intolerant folks making a scene about a proposed new Islamic center in Murfreesboro, TN (where I lived for two years before moving into Nashville). It has been skewered on The Daily Show this week and previously.
Yesterday, construction equipment for the center was apparently doused in gasoline and set on fire.
I don’t think I need to spell out how intolerable and sad and hateful that is, but I just wanted to say something to clearly oppose this type of action, and to say how disappointed I am that there has been opposition at all, but especially that it came to this.
The local Daily News Journal has coverage.

Twelve Step recovery wisdom can benefit everyone
All of us—recovering alcoholics, addicts and non-addicts alike—can benefit from the practical wisdom of the Twelve Steps, first developed by Alcoholics Anonymous (AA) and subsequently adapted by other groups whose members struggle with various forms of addictive behavior.
Recovering people know they are always vulnerable to relapse. That knowledge keeps them vigilant, and that’s why they take a mind, body and spirit approach to life every day to avoid slipping into behaviors that caused them and their loved ones so much pain.
The strategies those in recovery employ to keep themselves clean, sober and serene are also good prevention tools. Awareness of what behaviors or "mind games" can lead to relapse can also keep a n...

I recently told a friend this. Being able to put such thoughts into concise expression hasn’t always been easy for me. In fact, in my past, I’ve actually had different ideals, which I’ve gravitated toward. These ideals had little to do with my aforementioned paraphrase.
I’ve done considerable research on my interests and passions as well as possible career options, which take advantage of the intersection of these areas. I’ve read numerous books on these subjects, seen documentaries and lectures on the topics, and sought out a variety of mentors and a number of individuals in my own career search a...

Here’s a story from the United Kingdom I’d certainly have included if I were writing that paper today:
A ten-year-old boy from Weston Super Mare has been put on a school “hate register” after he allegedly made a homophobic insult in the playground.
Peter Drury, a pupil of Ashcombe Primary School, is believed to have called one of his friends a “gay boy,” according to his mother.
The boy’s mum says she was called into her son’s school to be told by head teacher that another mother had heard him using homophobic language.

As most of my readers probably know, the US congress passed a hate crimes law late last year that covered violent crimes against five groups of victims: people victimized on the basis of sexual orientation, religion, national origin, gender/gender-identity, and, most relevant to this blog, disability (it also covers crimes against people perceived to be in these classes by the attackers and crimes against military servicemen). It also does some other things, like pay a bit to local law enforcement for prosecuting hate crimes and establishing new categories for the FBI to track hate crimes as part of their statistics on crime. (The rest of this post is likely US-centric, due to the nature of this law)
What it does not do is limit anyone’s speech. In fact, the law specifically says two...

Steps to Wisdom
Twelve Step recovery wisdom can benefit everyone
All of us—recovering alcoholics, addicts and non-addicts alike—can benefit from the practical wisdom of the Twelve Steps, first adopted by Alcoholics Anonymous (AA) and subsequently adapted by other groups whose members struggle with various forms of addictive behavior.
Awareness of what behaviors or “mind games” can lead to relapse can ...

My new post on Politics Daily / Woman Up:
But with a small dose of gratitude from my corner. Let me explain.
Pastor Fred Phelps and his flock (and I mean that literally, since church members are rumored to be first-degree relatives) are back in the news again. On Monday, the group staged a protest at a high school in Washington D.C., written up by my Politics Daily colleague Joann Weiner.
The Westboro Baptist Church, designated a hate group by both the Anti-Defamation League and the Southern Poverty Law Center, may be located in Topeka, Kans., but most Kansans would be happy if Floyd Phelps and his church disappeared back into the time warp from which they came…

Stuart Taylor has a very good article this week about the Obama administration, international law, and free speech. This excerpt begins with a quote from Harold Koh, Obama’s top lawyer at the State Department:
“Our exceptional free-speech tradition can cause problems abroad, as, for example, may occur when hate speech is disseminated over the Internet.” The Supreme Court, suggested Koh — then a professor at Yale Law School — “can moderate these conflicts by applying more consistently the transnationalist approach to judicial interpretation” that he espouses.
Translation: Transnational law may sometimes trump the established interpretation of the First Amendment. This is the clear meaning of Koh’s writings, although he implied otherwise duri...

Law professors James Jacobs and Kimberly Potter make an interesting point:
Laws do not spring forth from a groundswell of public opinion, but rather are the product of lobbying by interested (”interest”) groups that must mobilize support among politicians. The hate crime laws are passed because of the lobbying efforts of organizations that advocate on behalf of blacks, Jews, gays, and lesbians, a few other ethnic and nationality groups, and in some cases, women. …Regardless of what it accomplishes, the passage of legislation boosts morale and the status of the organizations and their constituencies.
That’s from their excellent book on the subject, Hate Crimes: Criminal Law and Identity Politics (Oxford University Press, 1998), p. 66.

The Senate is about to vote on Defense Department funding with an expanded federal “hate crimes” bill. This well-intentioned piece of legislation threatens to make violations of the fundamental right against Double Jeopardy a routine practice, as federal courts will now have the power to re-prosecute defendants for what are traditionally state crimes.
The House removed language that the Senate put in place to ensure that the “hate crimes” provisions did not stretch to encompass free speech, threatening to attach criminal liability to core rights of free expression.
This expansion of federal jurisdiction guarantees that high profile cases will be retried until a guilty verdict is obtained to satisfy political factions. This politicization of justice will only harm ou...

Last night, the House of Representatives approved a defense spending measure that included a totally unrelated bill that would ban so-called “hate crimes.”
I’ve testified twice against federal hate crimes proposals. Here’s the case against the law (in brief):
First, the federal hate crime law is unconstitutional because it is beyond the powers of Congress.
Second, the law will not prevent violent crime. Anyone already inclined to kill or beat up another human being is not going to reverse course because Congress passes a new law against violence motivated by bias.
Third, the law does take the state too close to the realm of thought crimes. In order for a prosecutor to prove the “hate” aspect, detectives have to dig into a person’s life,...

Unsure about prospects on passing the Local Law Enforcement Hate Crimes Prevention Act as a stand-alone bill, proponents intend to attach it as an amendment to the Department of Defense Authorization bill. As I have said previously, this bill is an affront to federalism and counterproductive hater-aid.
Federal Criminal Law Power Grab
This legislation awards grants to jurisdictions for the purpose of combating hate crimes. It also creates a substantive federal crime of violent acts motivated by the “actual or perceived religion, national origin, gender, sexual orientation, gender identity, or disability of any person.”
This is a federalization of a huge number of intrastate crimes. It is hard to imagine a rape case where the sex of the victim is not an issue. The same goes for r...

Last week’s Senate Judiciary Committee hearings (video at the link) on the proposed federal hate crimes bill showed the dark underbelly of the Senate. The road to undermining the rule of law is being paved with the best of intentions and casual disregard (if not outright hostility) for the principles of limited government and equality under the law.
I raise some objections to the bill in this podcast:

The bill federalizes violent acts against victims by reason of their actual or perceived race, color, religion, national origin, gender, sexual orientation, gender identity, or disability.
Never mind that these acts are already prosecuted by the states, and that violent crimes of this nature are universally perceived as an affront to justice. Matthew Shepard, the gay man brutally kille...

On June 10th, Officer Johns was at his post at the United States Holocaust Memorial Museum. It’s a sad testament to the state of the world that, at a museum dedicated to proclaiming the horrors of hate, that a guard would even be needed. But, sadly, guards are needed there. Spotting a visitor whom he thought needed assistance opening the door, Officer Johns unknowingly opened the door for his killer. In dueling newspaper opinion pieces last year, Los Angeles County Sheriff Lee Baca maintained that race fueled gang violence while Los Angeles Police Chief William Bratton said skin color was seldom a factor.
“If you do a survey within the African-American community . . . you are in constant fear that your young male offspring is going to be killed because of the color of his skin,” Baca said in an interview after his piece appeared in the Los Angeles Times.

With the support of President Obama, so-called “hate crime” legislation is on the move in Congress. According to Cato senior fellow Nat Hentoff, laws that punish one time for the crime and another time for the hate violate the First Amendment, the 14th Amendment and protections against Double Jeopardy.
In April, Hentoff spoke at the Cato Policy Perspectives seminar in New York City about the current expansion of hate crime legislation. (Source: Cato-at-liberty)

It would be easier for North Carolina Rep. Virginia Foxx to drive a school bus through a subway turnstile than to try and explain herself via an attempted apology.
Appearing on MSNBC’s Rachel Maddow Show, the mother of Mathew Shepard, Judy, said the Congresswoman was apologizing for semantics, not the sentiments expressed.

I recently got some love mail from a drug addict. Odd…but very respectable!
I just want to tell you, as a scum-sucking addict, how grateful I am for pharmacists who DO NOT cater to those in active addiction. Obviously, I used to HATE people like you, who were not only doing their job, but doing it well. I now attend Narcotics Anonymous meetings several times weekly, and I would likely not have gotten here if not for good pharmacists like yourself making it even more difficult to feed my addiction. I hope you continue to write informative and entertaining articles in this blog, and I hope that your day is a good one.

I apologize for getting you tangled up in what I have declared ZAZZLEGATE. All I wanted to do was ensure that more people were able to view the “Angriest Store” and receive updates on when I create new shirts.
As you can see on the right, there are, as of right now, there are 266 of you. I let my guard down. I stopped being cynical for one moment. That moment allowed an inept online retailer do something so stupid, so brainless, so inconsiderate that it has essentially compromised all of your email addresses.
I exported the email addresses out of my database (where they are very much secure) to my computer. I then formatted them into a CSV and put them into a specific form...

I only bring this up because it provides a vivid example of how so much of the West has become, in the old Gilbert and Sullivan phrase, topsy-turvy. The Dutch Government is bringing a parliamentarian named Geert Wilders up on charges of hate speech for making incendiary statements about fundamentalist Islam. From a blog opinion article about the event:"The Freedom Party (PVV)," read yesterday's press release, "is shocked by the Amsterdam Court of Appeal's decision to prosecute Geert Wilders for his statements and opinions. Geert Wilders considers this ruling an all-out assault on freedom of speech." The appalling decision to try Wilders, the Freedom Party's head and the Dutch Parliament's only internationally famous member, for "incitement to hatred and discrimination" against Islam is ind...

From Battle of Ideas: “The dubious science of evolutionary psychology”
“Evolutionary psychology prides itself on being a valid, scientific account of human psychology (and behaviour) by tying itself to the scientific theory of natural evolution. But evolution is an explanation of physical, anatomical traits . . . The plausibility of evolutionary psychology rests on the question of whether psychological attributes (patriotism, altruism, romantic love, aesthetic judgments, logical reasoning, recollecting your grandmother’s birthday, and studying to get into college) are analogous to anatomical structures in the...

It often surprises me that life-changing brain facts stream daily, from remarkably reliable sources, and yet so few key facts are used to transform firms. Here are 25 work related facts recently released from several brain sciences, but often ignored by most organizations. Could this failure to capitalize on the brain at work, be the reason why: 1. We rarely see significant changes that benefit all. 2. Most people surveyed state that they hate their work. 3. People increasingly report illness and remain home from their jobs. 4. The economy is groaning and yet without solutions in sight. 5. More and more people are leaving careers or country for good. What insights about the human brain could improve your situation at work? (Source: BrainBasedBusiness)

It’s not unfitting that a week in which a new study further disputing the MMR vaccine-autism link appeared would end with the publication of a book with no less a title than Autism’s False Prophets: Bad Science, Risky Medicine, and the Search for a Cure, and by no less an author than Dr. Paul Offit, chief of Infectious Diseases, the director of the Vaccine Education Center at the Children’s Hospital of Philadelphia. In the words of Orac of Respectful Insolence, Dr. Offit is the “Dark Lord of Vaccination” himself, and the special target, now for some time, of the ire, rage, and general hatred of proponents of a vaccine-or-something-in-vaccines-autism link.

On a list I’m on, there’s a lot of talk about how to respond to hate speech. As many readers know, what one would think is a non-controversial idea - that autistics have a right to enjoy life, communicate their experiences, be free from cruel or unusual “treatment”, and be treated as full members of the human race (not lesser or partial beings) - is in fact quite controversial to some. We’ve been called sub-human, empty shells, and damaged. We’ve been told that it would be a better world if people like us did not exist, and even that it would be more human to murder us before we “knew what was going on”. This is hate speech, plain and simple, and must not be tolerated.
But there are tons of ways of responding. The responses need to vary with ...

Hey, I think it is important that patients be given the same brand that they have been taking. Its not the same, no matter what you learn in pharmachology school. Studies show that two brands of the same drug can vary as much as 20% in concentration. That is a big deal if your epilepsy dosage is a carefull balance of seizure control and side effects, or if you are taking psychiatric medications whereby flucutating concentrations can lead to mental instability. 20% can be a big deal and patients diserve reliabaility. Taking the same brand may at least lessen the likelyhood of dosage differences or drug release patterns in the case o...

Do you ever find yourself in the same difficult and perplexing situations over and over again? You start to wonder if the universe is trying to teach you something or it is some heinous personal defect since the only constant element in all these situations is you. Or in this case, me. My particular situation is that am finding it increasingly difficult to be in the company of people. I have a couple things going against me. First of all I have terrible social anxiety complicated by some pretty weird phobias. Any social situation is pretty agonizing on most levels. Secondly I am very sensitive to the emotions of others and so called ‘vibes’. Just very aware of the undercurrents of most interactions. Some therapists think this is why I have such bad anxiety. It is like I am lacking s...

It’s no secret that secondary schools stunt teen talents and universities often lack intelligent actions that business craves. Nor is it surprising that disillusioned seniors seriously suspect they are over the hill and simply stop developing their brain’s peak potential. Increasingly workers vent about problems at work … while organizations struggle against staff who hate their work, and competitors who move their most successful operations abroad. It's no wonder we see absenteeism and financial loss on the rise here in the US.
A shocking 75% of workers dislike their jobs … while others find support to help them advance in their career goals. Have you noticed that in your organization? More importantly … have you wondered why some grow in the same settings that take others out? It comes down to using your brain at work as both a tool to reduce toxic barriers … and a map to locate the support you deserve. Regardless of how you feel … simply do a few things differently … and watch the brain’s plasticity propel you to new peaks. When relationship problems surface … for instance … people win support by building goodwill … even with those who disagree. How so? This weekend, I was asked for my advice on a drug that said family friend had been prescribed out there and had brought back with her. When I say advice, I mean an elaboration, or an explanation as to why it's important that she takes the drug at the required time. The family friend is elderly, and has little understanding of what her different drugs do, but she's happy to follow instructions if she understands why she has to do them. I asked what the drug had been prescribed for. "My high blood pressure," she replied. "Oh, I didn't know you had high blood pressure," I said. "Did the doctor out there measure it for you...

I've been bad at anonymity, and as I progress through the program, I want to work it right. That twelfth tradition matters as much as the rest of it, so it's important not to compromise myself. I've also been avoiding too many details because the details are really rather ugly. There are beautiful transformations happening in my life, but they are happening to me, alone. They aren't happening to my husband, not yet. They aren't happening to my marriage. But I need to talk about this stuff, and it's probably too early to start making program calls, so I'm going to tell the internet my business like I used to. The state’s capital city is not only home to the infamous Fred Phelps and his Westboro Baptist Church, and has recently been the battleground for Intelligent Design vs Evolution counter-counter-legislation by the school board (currently with the majority ruling pro-science), but now the capitol is host [...] (Source: Andrea's Buzzing About:)

Follow dissatisfied peers around for a day and you’ll likely see one or all of these reasons people hate their jobs.1. Relationship problems surface in projects at work … so that people take potshots at rivals without elevating any discussion. The turnaround would be to build goodwill with others – especially those who disagree. 2. Boredom comes from routines. Why not start work today with the question … “What could I invent?” 3. People expect too much … and you fail to catch many new ideas that fly by and are to be implemented. You’d be able to apply what you are learning more … if you hook new ideas onto something related that you already know or do.4. Problems rarely get solved and so people tend to complain and vent. Recognize t...

A man who is suspected of being a guard at a Nazi concentration camp has been found by US officials in Atlanta, GA.
Despite the fact that the things he is accused of doing occurred 65 years ago, it’s still very important - vital in fact - that human rights abusers face justice. It’s not a matter of revenge or preventing them from harming others, neither of which is likely to be served by picking up senior citizen Nazis. Instead, it’s about justice - and respect for the millions who died because men like this man refused to stand up to a system, and, in fact, joined that system. It is for the victims, both living and dead, that we must seek justice. We must never forget. The consequences of forgetting this history, failing to seek justice…it’s something that mu...

Personally I'm not so ruffled by shots either (but my liver begs to differ). However, in a message posted on The Islet Foundation, Pfizer reported that insulin-dependent diabetics declared they most hate taking shots. Was this the warm-up for the Exubera campaign? Here's a fact I support! A close second to this hatred is the hypos. Any diabetic will confess -- hypos are unforgiving. So what if you could catch two birds with one capsule?
I must reiterate the scientific genius behind the Oramed gel caps. The encapsulated insulin bypasses destruction in the stomach cavity. It reaches an entry point in the intestines where it reports for duty to t...

I know all about how these sites buy each other out so I did what they told me and signed into my Yahoo! account. It then took me to a page where it asked if I wanted to start up a new Flickr account or associate my old one with my Yahoo! account. Well, obviously, yes, I would very much like to merge the two accounts opposed to starting up a new one. So it asked me to provide my Flickr account ID and password to do that. I laughed my ass off and really enjoyed the show but it is almost a little too lifelike in many ways. I guess that is the beauty of it.
This article really says little against Rep. Keith Ellison, but it speaks volumes about Faux News, and what it doesn't want you to think about. And that, by the by, is the way to read and source Right-Wing propagandists, such as Faux News, "Newsbusters" and Freep. Consider the source and it's intended message along with what any particular message it might have. That and a good fact-checking will keep your credibility intact when opining upon such matters.Edit: I found this article at Right Web just after I hit "publish." "A Great Little Racket": The Neocon Media MachineNot by any accident, the neoconservatives' time of greatest influence on U.S. foreign policy coincided with the explosive growth of mass media outlets from which they could promote their policies.
US House Keeps Cheney Budget IntactYesterday, I was heartened to hear that a bill had been introduced in the US House to cut off funding for the Office of Vice-President Dick Cheney. This bill was introduced in response to the Vice President's legal efforts to avoid providing documentation and details of his activities to House oversight. The apparent secrecy of this administration is unprecedented in my lifetime and I lived through the Watergate scandal and the Nixon administration. I had hoped that his bill would succeed in bringing the Vice President into line to recognize that he and his office are not above the law. Sadly, the bill was narrowly defeated today.URGENT: Please call your Senators to support Senate Bill 1105, the Matthew Shepard ActFrom the Human Right Campaign:Today Sen. ...

You've got to watch this video. It was produced for Cyndi Lauper's True Colors tour this summer, and it's a pretty amazing testament to one of most heartbreaking problems in our country today. Thousands of people are attacked every year because of their sexual orientation, and there's still no federal hate crimes law to protect them. It would mean a lot to me if you could take a minute to watch the video and write your Senators. And I’m watching America with wry amusement. Since I’m a second-class citizen — a gay man — my seats for the ballgame of American discourse are way back in the bleachers. I don’t have to wait long for a shock jock or stand-up comedian to slip up with hateful epithets aimed at me and mine. Hate speak against homosexuals is as commonplace as spam. It’s daily traffic for those who profess themselves to be regular Joes, men of God, public servants who live off my tax dollars, as well as any number of celebrities. In fact, I get a good chuckle whenever someone refers to “the media” as an agent of “the gay agenda.” There are entire channels,...

Press Release from freepress.netThe controversy over Don Imus' racist remarks goes far beyond one bigoted commentator. But getting rid of Imus won't fix the media problem. Most of our TV and radio stations are owned by giant corporate conglomerates. They don't represent the views of most Americans -- and they make huge profits off the public airwaves. What we need are more diverse, independent and local media owners. Yet right now less than 10% of TV and radio stations are owned by people of color or women. But instead of addressing this national disgrace, the Federal Communications Commission is actually trying to let the largest companies buy up even more stations! Tell the FCC: We Need More Diversity in the Media What Imus said is just the tip of the iceberg. Scores of other TV and ...

An article in today’s New York Times notes that “millions of dollars in future donations” for children’s charities may have been lost “as a result of his ill-considered remarks”:
For four and a half hours this morning, he turned his radio program into a live fundraiser for three charities — two benefiting children with cancer, and the other for families that have lost babies to sudden infant death syndrome — an endeavor he has undertaken each of the last 18 years.
Among the guests were children and parents who had been the beneficiaries of his efforts — particularly the Imus Cattle Ranch for Kids with Cancer, a p...

I report abuses of autistic people in a few different places, as I become aware of them. (For instance, LiveJournal Autistic Abuse Community) I try to be fair, and try to minimize any editorial comments about the abuse, as I think it is really important to not make abuse reporting into a political game.
Some people still see my reports (mostly linking to news reports) as political.
I’ve been accused of being anti-parent. Usually what happens is several abuses (or murders, in the worst cases) occur at the hands of parents. I report on each of these, as I think they are worth mentioning in the context of the abuses autistic people face.
