The Treaty Clause Doesn’t Give Congress Unlimited Power

By Ilya ShapiroIn 1920, the Supreme Court decided an obscure case concerning the implementation of a treaty between the United States and Canada regarding migratory birds. Tucked into Justice Oliver Wendell Holmes’s five-page decision in Missouri v. Holland was a sentence that expressed a truly startling idea: that Congress can transcend its enumerated powers via its power to implement treaties.
That is, although Congress has no enumerated power to pass, say, general criminal laws, if a ratified treaty with France demands that we pass such laws, then Congress’s power expands to allow for such legislation. Thus, foreign nations and the executive branch are given the power to change, almost at will, one of the most hotly debated and carefully crafted sections of the Constitution,...

Long-Stemmed Rainbow Roses: Kitschy or Cool?

You gotta love these trippy rainbow roses (or do you?) — even if you’re a snob (like us) who thinks that dyed flowers are beyond tacky. They’re made by inserting colored dyes into different parts of the stem, which results in multicolored petals. These buds were developed in Holland (so shouldn’t they be tulips?), and will cost you (or your wealthy suitor) $55 to $325. We can’t stop staring. Because they’re real.
Can you dig these psychedelic flowers – or do you prefer roses that don’t remind you of ’shrooming in college?

We’re all for women with smart business plans, but we’re not quite sure what to make of Danish porn star Bobbi Eden’s new strategy: The buxom blonde announced that she would give blow jobs to all of her Twitter followers if Holland wins the world cup. She made the patriotic and social media-savvy announcement on Tuesday, and her Twitter followers have gone from 4,000 to 66,163. (Are you or your partner one of them?)
The fateful match determining the exhausting work ahead of Bobbi takes place this Sunday, when the Netherlands and Spain vie for the world championship – and a lot of bragging rights.

The issue of simplicity vs. complexity is, well, complicated. In business, simplicity and brevity are usually greatly preferred, but in marketing trying to get your message into a few words sometimes doesn’t work as well as longer text. For example, some of the most effective direct sales letters are lengthy, running many pages [...] (Source: Neuromarketing)

By Neal McCluskeyAs freedom-minded folks have been celebrating major setbacks for Obama Care, campaign-speech control, and lots of other attacks on liberty, some have been sounding the alarm over the insidious “Race to the Top” contest. A couple of siren blasts I just caught are well worth taking in yourself, one by the Heartland Institute’s Robert Holland and the other by Colorado Board of Education member Peggy Littleton. In particular, the writers think they see the handwriting on the wall in the de facto requirement that states promise to adopt as-yet-unwritten “common” (read: national) standards to compete for RTTT funds. As Littleton writes:
We already know that the federal government, or at the least consortiums of states, wants to develop asse...

Shame on you if you let the dark site of autism win! ;-)) Enjoy life! Here is a reason why being diagnosed and labeled with a disorder like autism has advantages!Imagine you walking in the crowd. Among all those anonymous faces and hidden personalities passing by will be others with disabilties. People who drink too much, addicts from A till Z, objects called human beings who have abused people and animals in all kinds of ways, people with bad temper, wrong genes, narcists, liars or just other nasty habits. Well, what do you know about those others walking by? Impairments are not always directly visible. Like autism many disorders often only can be experienced when dealing more with people. There are at least 50 others who should see a psychiatrist when you are in a crowd of 100, I think. ...

Been there before. Kind of tradition, this was my second visit.Perhaps due to my autism I can loose myself completely into music. For years I did not dare to go on my own to such events. Now I know it might likely more fun going together, but this is also ok.Waiting for the train, blogging this on the road.Whising you a good evening en see you tomorrow Easter Sunday!Yes I bought chocolate eggs but no golden ;-)Take careA.Bird.
Let's keep it clean and simple for a Friday (it'll get plenty dirty and disorganized tomorrow as Holland healthcare/tech luminaries cluster for the first Dutch Health 2.0 unconference). It should be ridiculously simple to establish trust among consumers, and communicate the value your healthcare organization provides. All you have to do is be sure each and EVERY message and interaction ('touch') reinforces the patient's perspective that we are receiving consumer-centric care designed just for us.This doesn't have to be painful for your communications team, and it doesn't mean you relegate good medicine and safe patient care to the sidelines. Case in point: the short, very sweet message I just got when I confirmed my subscription to Method's email blast.Instead of a boring line telling me...

This morning's Wall Street Journal features an article about the healthcare system in the Netherlands, which some see as a model for the U.S. system, which is widely acknowledged to be broken. Contrary to many other countries in Europe from plans in other parts of Europe which are largely national health care plans, the Dutch system also differs from U.S., which largely relies on employers paying for the bulk of coverage.Recent reports by the U.S. Census Bureau have found that 47 million Americans (somewhere around 14-17% of the population), most of whom are working full-time jobs, lack healthcare coverage. However, for many -- especially those with what are commonly referred to as "pre-existing conditions" like diabetes or heart disease, its almost impossible to obtain a private insurance...
