A friend sent me a press release a few days ago and I still find myself thinking about it. Here in the United States capital punishment is still legal in many states and is performed, frequently, by lethal injection. Prisoners sentenced to death have an IV placed in their arm which is then infused with the following three solutions:

A barbiturate like Sodium Pentothal or Nembutal, used to induce anesthesia
A paralytic like pancuronium bromide or succinylcholine chloride, used to stop respiration
Potassium chloride used to stop electrical conduction in the heart

I remember a few years ago drug manufacturer Hospira, the producer of Sodium Pentothal, issued a statement that it disapproved of its drug being used in capital punishment. But, that was as far as their opposition went and, alth...

For the second time this month, the US International Trade Commission has agreed to investigate a complaint hinging on a patent dispute involving different drugmakers. This time around, Femira Pharma accuses Merck and numerous retailers, including CVS Caremark Wal-Mart, of infringing on a patent because the drugmaker and pharmacies import or sell Merck’s NuvaRing vaginal ring birth control device (see the ITC notice).
In its complaint, Femira argues its patent generally relates to a medicated intravaginal device, such as a vaginal ring, for transvaginal delivery of a medication to a woman’s uterus. Femira also maintins the drug delivery system described in its patent allows delivery in lower concentrations than those needed for systemic treatment and so offers a lower systemic ...

In an unusual move to thwart generic competition, Eli Lilly has succeeded in convincing the US International Trade Commission to investigate its complaint that Hospira and three suppliers are using a manufacturing process that infringes a patent on its Gemzar cancer med. And Lilly hopes the ITC will block importation of Hospira’s generic version, which is known as gemcitabine (see ITC notice here).
In its complaint, Lilly charges that the patented method for making Gemzar, which is used to treat breast, lung, ovarian and pancreatic cancer, is “the most commercially viable process available for manufacturing gemcitabine” and “involves less steps, higher yields and lower costs,” according to the Lilly complaint. Hospira and its suppliers are charged with illegal...

After spending more than a decade growing into a behemoth by single-mindedly pursuing big acquisitions - think Warner-Lambert, Pharmacia and Wyeth - Pfizer is now signaling a change of heart. To wit, the drugmaker is said to considering the spin off or sale of all four non-pharma units, including nutritionals, consumer health, animal health and a business that makes capsules.
Moreover, Pfizer may even shed what it calls the Established Products division, a $10 billion operation that includes off-patent meds, the Greenstone generics unit and biosimilars, according to an investor note from Sanford Bernstein analyst Tim Anderson. He writes that such moves would trim Pfizer nearly in half - from about $67 billion in annual revenue to between $35 billion and $40 billion.

Should The FDA Review Drugs Used For Executions?

The ongoing shortage of a drug used for prison executions has now ensnared the FDA. Six inmates on death row in prisons in Arizona, California and Tennesse yesterday filed a lawsuit claiming the agency violated federal law by allowing the states to import thiopental sodium, even though there was no official review for safety and effectiveness. In other words, there are no approved suppliers.
The shortage began when Hospira stopped making thiopental in 2009, prompting prisons to seek alternates. Last month, the FDA decided to permit imports, but declined to vouch for the meds, even though one recent execution may have involved an expired import (back story). “Reviewing substances imported or used for the purpose of state-authorized lethal injection clearly falls outside of FDA’s exp...

And The List Of Drug Shortages Keeps On Growing…

Certainly, at hospitals. In fact, the shortage of injectable generics for cancer and other serious diseases is forcing many hospitals to scramble to locate meds or find alternatives. In some cases, the FDA has allowed imports, but the agency approval process has also meant fewer new available generics. “We think this is near a crisis situation,” Bona Benjamin, a director at the American Society of Health-System Pharmacists, a pharmacist trade group, tells The Wall Street Journal.
Numbers, of course, help tell the story. The FDA reports a record 178 drug shortages in 2010, up from 157 the year earlier and 55 five years ago. And here is the latest list. You’ll notice this is much shorter than the list indicating shortages that have been resolved (take a peek).
The problem,...

The drug is part of a cocktail given to many patients who receive the death penalty by lethal injection and had until recently been manufactured at Hospira’s Virginia facilities.
For those who like to keep track of the revolving door between industry and regulators, it is worth noting that Gary Buehler, who for many years ran the FDA’s Office of Generic Drugs, is joining Teva Pharmaceuticals as vp for regulatory strategic operations. Teva, of course, is the world’s biggest supplier of generics.
The move comes just a few months after Buehler was reassigned to run the FDA’s Office of Pharmaceutical Science after FDA commish Margaret Hamburg complained publicly about a backlog of generic drug approvals (back story). The backlog went from 891 in fiscal year 2005 to 1,912 in fiscal year 2010, although Buehler was known inside the FDA to battle for funding for reviewers.
To cope, the agency continues to explore the notion of imposing user fees on generi...
