A federal judge in Virginia has ruled that healthcare reform is unconstitutional and expects the Obama administration to honor that ruling while it’s being appealed. But states and private companies are continuing to plan and budget for it nonetheless.
The court ruled that Congress exceeded its constitutional powers in compelling Americans to buy health insurance. Judges elsewhere have ruled the law is valid or dismissed the cases on procedural grounds, while a judge in Florida will hear another case later this week.
In the meantime, though, employers and healthcare companies have to continue adjusting to the reform law’s many provisions. States will continue to set up their health insurance exchanges, and they’ve already budgeted for the additional 16 million people who ...

By Roger PilonToday POLITICO Arena askes:
How badly does today’s ObamaCare ruling set back the Democrat’s signature domestic achievement? Should Tenth Amendment enthusiasts take heart that other federal laws with which state officials disagree can be struck down?
My response:
A quick reading of Judge Henry Hudson’s opinion today striking the “individual mandate” provision of ObamaCare gives hope to those of us who have long urged, more broadly, for a restoration of limited constitutional government. As Judge Hudson put in granting summary judgment to Virginia, “the legislative process must still operate within constitutional bounds.”
The administration had argued that Congress had authority to enact and enforce the individual mandate to buy healt...

My sister and I recently had the opportunity to take a lovely evening stroll across the Hudson River on the longest pedestrian bridge in the world.
The Poughkeepsie, New York railway trestle opened to train traffic on Jan. 1, 1889, and was closed after a fire in May, 1974. For years it stood abandoned in silent testimony to the City’s shrinking industrial base.

The idea of saving the trestle and turning it into a walkway began as the vision of local volunteers. Once work began, it took 16 months and $38.8 million to build the walkway, which is managed by the state of New York as Walkway Over the Hudson State Historic Park.
In a society that all too often simply throws away resources, congratulations to New York and Poughkeepsie on making such excellent use of this piece o...

I’ve always questioned exactly where big pharma ends and the regulators begin.
Certainly the MHRA (the UK’s medicines watchdog) has always had VERY close ties to the drug industry, and I mean VERY close.
The revolving door that connects the MHRA and GlaxoSmithKline (in particular) has always been well used.
The Chairman of the MHRA, Alasdair Breckenridge, is a former employee of GSK (then known as SmithKline Beecham), as is the Head of Licensing at the MHRA, Dr. Ian Hudson.
Breckenridge has a track record of publically supporting Seroxat (but not really very well!)… Hudson is much more interesting – he worked at SmithKline Beecham for 11 years (Glaxo 2 weeks) as Worldwide Director of Safety. He then joined the MHRA as its Head of Drug Licensing.

Just one look at Kate Hudson, Evangeline Lilly, Kelly Ripa, and Anna Paquin’s lithe limbs and you’ll be reaching for the dumbbells. How’s that for motivation?

By any measure, giving programs directed at developing countries by research-based pharmaceutical companies are the most generous of any industry. The Geneva-based International Federation of Pharmaceutical Manufacturers and Associations (IFPMA), whose methodology and data presented in its most recent “Partnerships Report” were validated by the London School of Economics, reported $6.7 billion in giving.
The 2009 “Index on Global Philanthropy,” published by the Hudson Institute, provides a measure of global private giving and, once again, demonstrates that private flows...

Well, I’d like it to be more open about one of its employees, Ian Hudson.
I’ve been wanting to get to the truth since January 2005 when the House of Commons Health Select Committee questioned some senior MHRA members about Seroxat (Paxil).
Here’s some background: Ian Hudson worked at SmithKline Beecham for 11 years (Glaxo 2 weeks) as Worldwide Director of Safety. He then joined the MHRA as its Head of Drug Licensing.
During his time at SmithKline Beecham and Glaxo he had “significant involvement” with a number of drugs, especially Paroxetine (Seroxat) and two others. We know this because of this document – Ian Hudson Interests – which he fill...

The Dog Days of Summer….this was an expression of my childhood during the lazy, hazy days of languid, humid heat and still seems to be a saying or description of this time of year from about July 3 to August 11. I recall my mom mentioning this when we were in the midst of haying and canning and the weather was hottest in the Hudson River Valley of New York State.
The term seems to go way back to mythology and the conjunction of Sirus (called the “dog star”) a...

We were walking down the West Side Highway in Manhattan on Saturday when Charlie started running and laughing. Jim and I saw that we were nearing the shed where you can take out a canoe into the Hudson River—-we had passed the shed back in April and met a retired longshoreman who’d noted how he likes to be near the water, and exchanged stories of the waterfront and Cockeye Dunn, a New York mobster who’s one of the characters in the book about the port of New York and New Jersey and the Waterfront priest that Jim is very, very close to finishing.
“Want a kayak ride?” asked Jim.
“Yes!” said Charlie. He paced back and forth pier 96 with the river splashing below him as Jim filled out some forms and I coaxed Charlie to put on a life vest. “No ves...

Below is the press release about the new autism legislation that New Jersey Senator Robert Menendez unveiled this morning in Weehawken, in Hudson County in northern New Jersey. The legislation has three parts: The creation of “autism navigators” to help families “navigate” their way through services, treatment options, and much more; the development and implementation of autism training for first responders (police, fire departments, emergency medical technicians and other volunteers); the creation of an HUD Task Force to address the “serious lack of sufficient housing” for autistic adults. The legislation is specifically about services and community supports.
The need for housing for autistic adults is underscored in a story from KGW.com in Washington s...

Senator Robert Menendez of New Jersey will be announcing a new initiative for families dealing with autism spectrum disorders on Monday, April 28th, at 11am in Louisa Park in Weehawken, New Jersey. The legislation will combine guidance for families seeking autism spectrum disorder services and care, greater public awareness of autism spectrum disorders and support for adults with autism. New Jersey has the highest prevalence rate of autism in the nation (1 in 94). I was was hoping to be in Weehawken which is not far from where I teach at Saint Peter’s College (it’s the Senator’s alma mater) but I have a class (and it’s the last week of classes). You can be sure my thoughts will be directed down Kennedy Boulevard……

We had been planning to take the train into New York as Jim needed to go to his office. He can only get into the building until 4pm on Saturday and during the week the train is the most efficient way to go, but weekends can be different.
“Sure why not? We haven’t driven in in a while,” I said, glancing back at Charlie in the backseat. He’d gotten a smooth buzz cut from Vince the barber and was rubbing the crown of his head.
The transportation gods must have decided to shine on us because we were up the Turnpike across from the Hudson River and then through the Lincoln Tunnel with ease. We left the black car in a garage on 57th street a...

Even though we weren’t Irish, we celebrated St. Patrick’s Day when I was growing up on a farm in the Hudson River Valley of New York State. Our hired man, a surrogate grandfather to us children, was Irish. Dan took his meals with us and stayed nights with a neighboring family where he did some caretaking.
Mother cooked corned beef and cabbage or boiled ham and cabbage for dinner that day. (On the farm, dinner was the mid-day meal, with often leftovers for supper, the evening meal.) She might make Irish soda bread and a cake with green tinted icing.
Dan always wore something green, and we children looked to see if he’d forgotten. (He never did.) This was a small green bow on the front of his cap, just above the brim.
Mother also had a ...

I hope that it is just publicity gimmick that Matthew McConaughey is now dating Kate Hudson.
You know, they have a movie to be released next month - Fool’s Gold - their reunion team-up on screen since the movie How to lose a guy in 10 Days.
Gosh. I’m just glad he dumped that Brazilian bombshell (Camilla Alves). Still, I’m jealous as hell of Kate to be in Matt’s arms. He he. :-(
Anyways, going back to cancer. Having it cannot be anyone’s gimmick.
Cancer changes people’s lives in more ways possible.
Like this veteran congressman (Rep. Tom Lantos) that is now retiring after being diagnosed of esophageal cancer.
Lantos, a California Democrat, is serving his 14th term in the House of Representatives. In a statement released by his office, the 79-year-old lawm...

The December 14th Guardian reports on a study that has found that geography, race, class and gender play a greater role in determining a child’s chances for getting help, over and above “the nature of the learning difficulty.” The study was done by Harry Daniels and Jill Porter of the University of Bath; their report states that:

“There is a pervasive gender bias, with not only higher incidence amongst boys than girls, but earlier recognition of boys’ difficulties.
I had a big project to finish for my job and Jim took Charlie on a Riverkeepers tour in the New Jersey Meadowlands: At 12 noon, they boarded a pontoon boat and, with the Captain providing a steady narration about evil developers and looming landfills, went up and down the Hackensack River. Jim interjected with a few questions and agreed with the Captain that no one in Hudson County takes an interest in nature, not that there isn’t plenty of it, from the phragmites reeds the boat pushed past to the many birds, as varied as the ethnicities of Jersey City’s population: People do tend to think more of the garbage and car part dumpyards and the smokestacks that I pass everyday on my way into Jersey City via the Pulaski Skyway (”one of the most notorious and dangerous roads in ...

Early this year, I agreed to volunteer to improve my Spanish language skills by translating a book of poetry for Mexican poeta Jeannette Clariond with illustrations by Chilean artist Victor Ramírez. The image that you see to the left (click on it to enlarge it) is the culmination of that effort. To thank me for my efforts, Ms. Clariond has given me 50 copies of this beautiful work of poetic and visual art for charitable purposes. I have to say that I am quite honored to have been asked to translate the texts and am proud of the results. In a gesture of paying forward and to the cause, I have decided to offer my own version of a "Translator's Limited Edition" of this work. I will include a signed insert with my biography as translator and the story of how this translation came about, includ...

I received word from Mario Meléndez of Chile twice this week to announce that his work has been featured in additional online publications. First from Blackmail Press, you will find a fairly substantial number of his poems. It does not surprise me in the least. When I was translating these poems, Mario was very diligent about helping me with nuance. I personally find his work to be striking, stunning, even shocking at times. He has a perspective that I understand and can relate to personally. I hope you will visit and let the poems sink in for a bit.Additionally, in the Southern Ocean Review, from New Zealand, two poems of Mario's work are included: Black Symphony and The Daughter of Rimbaud. I hope that you enjoy and appreciate Mario's work as much as I do. He is a good soul and patient ...
