Over the last twenty years, the social scientific understanding of human behavior has taken a significant leap forward. Important advances in several fields have increased the complexity and accuracy of prevailing models of individual actors, group dynamics, and communication. Unfortunately, too few of the key insights of that scholarship have been incorporated into the theory or practice of human rights promotion. In this project, we collect research from a broad set of disciplines and analyze its implications for hu...

This week, the National Latina Institute for Reproductive Health and other organizations have been observing the second annual Latina Week of Action for Reproductive Justice:
This year’s theme is Caminamos: Justice for Immigrant Women. We’re inviting everyone to join us in moving toward a brighter future for immigrant women and their families. Mean-spirited enforcement, workplace exploitation, and the criminalization of basic rights like education and health care are just a few of the challenges that have forced immigrant women into the shadows and ignored the crucial, positive role we play in our communities.
Action items for the week include calling for a review of the 287(g) program and online discussion on the theme, “what’s the real problem behind the targeting of ...

By Ian VasquezA new World Bank working paper by Jean-Pierre Chauffour (author of the Cato book, The Power of Freedom: Uniting Human Rights and Development) finds that freedom is the root cause of development. In contrast to economic, political and civil freedoms, Chauffour finds that “beyond core functions of government. . . the expansion of the state to provide for various entitlements, including so-called economic, social and cultural rights, may not make people richer in the long run and may even make them poorer.”

By Christopher PrebleThe news media is abuzz with speculation about what President Obama will say in an address this Thursday at the State Department. The topic is the Middle East, and White House Press Secretary Jay Carney explained, “we’ve gone through a remarkable period in the first several months of this year…in the Middle East and North Africa,” and the president has “some important things to say about how he views the upheaval and how he has approached the U.S. response to the events in the region.” The speech, Carney hinted to reporters, would be “fairly sweeping and comprehensive.”
If I were advising the president, I would urge him to say many of the same things that he said in his June 2009 speech in Cairo, this time with some timely references...

By Daniel J. MitchellI’m not a big fan of the IRS, but usually I blame politicians for America’s corrupt, unfair, and punitive tax system. Sometimes, though, the tax bureaucrats run amok and earn their reputation as America’s most despised bureaucracy.
Here’s an example. Earlier this year, the Internal Revenue Service proposed a regulation that would force American banks to become deputy tax collectors for foreign governments. Specifically, they would be required to report any interest they pay to accounts held by nonresident aliens (a term used for foreigners who live abroad).
The IRS issued this proposal, even though Congress repeatedly has voted not to tax this income because of an understandable desire to attract job-creating capital to the U.S. economy. In oth...

Step by step—so quietly, in fact, that the full facts of it can be startling—China has embarked on the most intense crackdown on free expression in years. Overshadowed by news elsewhere in recent weeks, China has been rounding up writers, lawyers, and activists since mid-February, when calls began to circulate for protests inspired by those in the Middle East and North Africa. By now the contours are clear: according to a count by Chinese Human Rights Defenders, an advocacy group, the government has “criminally detained 26 individuals, disappeared more than 30, and put more than 200...

By Malou InnocentTonight, to sell the illusion of America's "limited military action" in Libya's civil war, President Barack Obama insisted that America had a moral imperative to intervene militarily, implying he will do so wherever foreign leaders commit atrocities against their people. This latest mission in the name of "humanitarian imperialism" is extremely dangerous. In fact, if all goes well in Libya, it might be just as bad as if we fail.
Consider, for instance, if I walked through a wall of fire and came out the other side unharmed. Although I came out safe and sound, my decision to walk through the wall of fire was still misinformed. My good outcome was simply one among a host of potentially terrible outcomes. After all, if I were to walk through that wall of fire again and...

By Daniel J. MitchellForget the Magna Carta and the Constitution. Don't pay attention to the end of slavery. Ignore the defeat of the Nazis or the collapse of the Soviet Empire.
If you want a real victory for humanity, European courts have ruled that people have the right to free soccer games on TV. Apparently, people are now "entitled" to anything that is "of major importance" to society.
Isn't that just peachy? Europe is slowly collapsing under the weight of the welfare state. Nations such as Greece and Portugal already have reached the point of fiscal collapse. But rather than address these problems, the political elites at the European institutions have decided on a modern-day version of bread and circuses for the masses.
Here's a blurb from the Financial Times.

By Daniel J. MitchellI’m not a big fan of the Internal Revenue Service, but I try not to demonize the bureaucrats because politicians actually deserve most of the blame for America’s complex, unfair, and corrupt tax system. The IRS generally is in the unenviable position of simply trying to enforce very bad laws.
But sometimes the IRS runs amok and the agency deserves to be held in contempt by the American people
Let’s look at a grotesque example of IRS misbehavior. It deals with a seemingly arcane issue, but it has big implications for the US economy, the rule of law, and human rights.
On January 7, the tax-collection bureaucracy proposed a regulation that, if implemented, would force American financial institutions to put foreign tax law above US tax law. Banks would be require...

Qatar has been awarded the 2022 World Cup.
Given the mysteries of FIFA (soccer’s world governing body) decision making, I was less sure than most that the United States had this one “in the bag,” despite what the New York Times described as “an apparently superior technical bid.”
Still, I was surprised that the pea-sized (okay, Connecticut-sized) Middle Eastern nation got the nod . . . and more than a little disappointed given the human rights record of the country.
FIFA was apparently drawn to the idea of the transformative power of football and the notion that a World Cup in Qatar could alter opinions of the Arab world. According to the head of Qatar’s winning bid, Sheik Mohammed bin Hamad al-Thani, the 2022 World Cup will “present a new image ...

National DNA database and psychiatric patients
The advent of DNA analysis as a powerful tool for crime detection has led to the creation of England and Wales’s National DNA Database (NDNAD). This is one of the world’s largest databases of DNA information, storing profiles of nearly five million individuals (1). We write to raise a concern about the potential impact of this database on people with mental disorders.
The NDNAD has long been the subject of scrutiny and criticism with regards to how DNA profiles are collected and retained and from whom. This is because the current regulations on DNA profile collection mean that the NDNAD includes DNA profiles of a larg...

Human Rights Council on human rights conditions in the U.S. In a word, we’ve got problems, especially concerning women, minorities, etc., but we’re trying to live up to the expectations of other human rights exemplars on the council — Russia, China, Saudi Arabia, Cuba.

Last week, several public interest groups filed a complaint with the United Nations High Commissioner for Human Rights alleging the Obama Administration’s US trade policy violates international human rights obligations. Specifically, the groups charge the White House has used the US Trade Representative’s ‘Special 301′ status toward foreign intellectual property law standards to promote policies that restrict access to affordable medicines (background). We spoke with Sean Flynn, who is the associate director of the Program on Information Justice and Intellectual at the Washington College of Law, about why this step was taken…

Let’s face it: The Middle East is a dangerous place to be if you’re a woman. Just last week we learned about innocent women locked up in an Afghanistan prison for fabricated crimes, and today we read on The Huffington Post about an Iranian mother of two who could be stoned to death at any moment.
Sakineh Mohammadie Ashtiani was accused of adultery in 2006 and received a punishment of 99 lashes. Her case was then re-opened, and she was put on trial for the alleged murder of her husband. Even though she was acquitted, the judge handed down her death penalty order – even though there was no evidence.
Last week, Amnesty International called for Iran to halt all executions, but the International Committee Against Stoning and the Death Penalty says tha...

When you think of prison inmates, you probably imagine people who’ve been accused of heinous crimes like murder, armed robbery, or embezzlement, but in Afghanistan, women are jailed for being accused of much less. At the only women’s prison in Afghanistan, at least half the women there are incarcerated under accusations of bad character, and other “moral crimes.”
Women are often falsely accused of crimes and jailed because of grudges or vendettas, or merely because their husbands are the ones who accuse them. When one woman’s husband claimed she was an adulteress, she was thrown in prison – all while she was three months pregnant with his child.
Putting their wives in jail certainly seems like an easy way for Afghan men to get out of being married and keep w...

The average woman in the United States will give birth to 2.06 children in her lifetime. In Uganda, the average is 6.7 children. Why? Birth control is virtually unavailable in this African nation. That’s not to say Ugandan women don’t want it, however. But even when a pregnancy would be risky to a woman’s health, she has no means of preventing it. A new short film, Empty Handed: Responding to the Demand for Contraceptives shares the plight of these women:

This article outlines a code of basic human rights applicable to the non-alcoholic.
You and your children have the right to:

a loving and secure relationship based on healthy mutual dependence;
peace and harmony in your home;
a stable, secure, and nurturing environment conducive to personal growth and self-discovery;
a healthy self-concept, knowing you are worthy, valued, and loved;
human dignity; to be respected and treated as an individual human being, and not be put down, demoralized, and dehumanized;
not live a life of “always waiting for the other shoe to drop,” never knowing whether it will be a soft slipper or steel-toed work boot;
a life free of the fear of emotional terrorism, physical abuse, and constant arguing;
a life free of nightmares, day terrors, and insecurity;

There is much rejoicing here at Frontier Psychiatrist HQ as both parties in the new coalition government are committed to abandoning ID cards and the National Identity Register. And that’s not all – the Contact Point Database is also toast. Page six of the coalition agreement has actually brought a lump to my throat.
However the fight against intrusive and unnecessary state run databases is far from won.
Since I posted last about the Summary Care Record it’s become one of the most popular posts on this site. Here is an update on what’s been going on.
As you may remember, the Summary Care Record is part of the NHS National Programme for IT. It is a national database which makes health records available for healthcare staff to access wherever a patient needs treatment, regard...

By Ilya ShapiroI recently returned from a short vacation — had to get it in before the Supreme Court begins announcing decisions in this year’s big cases and the president nominates a replacement for Justice Stevens — but it seems that I’m a chump for paying for it myself. While I was gone, the EU’s commissioner for enterprise and industry, one Antonio Tajani, declared that vacationing is a human right, one that ought to be paid for by the taxpayers:
Tajani, who unveiled his plan last week at a ministerial conference in Madrid, believes the days when holidays were a luxury have gone. “Travelling for tourism today is a right. The way we spend our holidays is a formidable indicator of our quality of life,” he said.
Tajani, who used to be transport commis...

Arizona, you are looking ugly. Defenders claim its Draconian measures are a result of the failure of US immigration policy, and I have to agree. Everyone seems to agree on the need for immigration reform, but like the weather, no one wants to do anything about it. The Democrats have a bill, but no one seems to think it will succeed in an election year and may be only window dressing, anyway. The bill puts securing the border first, followed by provisions for fraud-proof identity cards. Bringing up the rear are tough requirements that would allow a path to citizenship for people currently within US borders illegally.

I think the Democratic bill is wrongheaded. It has everything backwards. I have a solution. It's simple, but I predict few of you will agree. Read the rest of this post... | ...

I know things are better when I read really weird stories like this one:

Earlier today, we told you about a Pennsylvania legislator who accused her primary opponent of pretending to be bisexual in order to get votes from the large LGBT community in her Philadelphia district.

At a fundraiser a week ago, state Rep. Babette Josephs (D) told supporters that they couldn't trust her opponent, Gregg Kravitz, not to cheat at the polls. He had lied before, she said.

"I outed him as a straight person," she said, "and now he goes around telling people, quote, 'I swing both ways.'" (Rachel Slajda, TPM)

Yes, that's right. A politician is accusing her opponent of being secretly straight. I don't know (or care) if Mr. Kravitz is telling the truth about his sexual likes and dislikes. Whether it's a li...

By Gabriela Calderon de BurgosOn Monday I wrote about an Ecuadorian court’s sentencing of Emilio Palacio, editor of the opinion section of El Universo, to three years in jail. Since then, the Inter-American Commission on Human Rights (IACHR) has expressed “profound concern” about the prison sentence for Palacio, and the Inter-American Press Association (IAPA) and Reporters Without Borders (RSF) have strongly condemned it.
Op-ed writers from leading national newspapers have signed a statement condemning the court’s decision. This statement was published in El Comercio, El Universo, Diario HOY and La Hora. So far 47 columnists have signed on. See an updated list here of those of us who express our solidarity with the accused journalist. (Source: Cato-at-liberty)

People living in London and four other strategic health authorities are currently receiving information in the post about the rollout of the NHS Summary Care Record (SCR) system. SCR is part of the NHS Care Records System, a large UK government IT project which aims for more effective sharing of patient records between NHS services. When the system is in full swing, NHS staff in Newcastle (say) will be able to access the medical records of someone requiring care whose residence and GP is in Penzance. The SCR will initially contain records of such things as medications and allergies, but may eventually become more detailed and also allow access to specialists’ letters and scans.
Controversy about this centralised system has been rumbling on for some time and before you read further ...

By Ian VasquezA report (PDF) released today by the Inter-American Commission on Human Rights condemns in well documented form the growing violation of human rights under the regime of Hugo Chavez. The 302-page study is yet another confirmation of the multitude of ways in which individuals, NGOs, union leaders, politicians, activists, businessmen, students, judges, the media and others who disagree with Venezuelan government policies are targeted by the government and its supporters through intimidation, arbitrary use of administrative and criminal law, and sometimes violence and homicide.
Among the many cases it documents, the report describes how the government last year shut down a publicity campaign in defense of private property run by our colleagues at the free-market think tank CEDIC...

Do yourself a huge favor, and invest the 22 minutes to watch and listen to this
Ted Talk by Aimee Mullins
about facing adversity. Carefully consider her message, and the potential impact of adaptation - you might just gain new perspective on “disability” along the way too.

My favorite quotes from the talk:
“We have to make sure that we don’t put the first brick in a wall that will acutally disable someone. Perhaps the existing model of only looking at what is broken in you and how do we fix it, serves to be more disabling to the individual than the pathology itself.”
“Adversity is just change that we haven’t adapted ourselves to yet.”
“I think the greatest adversity that we’ve created for ourselves is this idea of normalcy. Who...

There’s an interesting discussion going on.
By now, many are aware of the proposed changes the DSM for autism that will subsume Asperger’s and PDD-NOS.
Some have expressed the view that this is a good thing, yet others seem to feign agreement while also expressing some degree of contempt.
Amidst the apparent concerns of a few, there are voices focused on the ethical and human rights implications of opposing the DSM changes. Particularly, please read Angry Aspies, Please Go Away by Bev over at Square 8.
On a side note: I know Bev to be a person who diligently promotes acceptance and human rights for all autistic people, and she’s apparently an early adopter of the pending new definition - she’s already changed the title of her blog and description of its purpo...

By Daniel J. MitchellIn a rational world, Switzerland would be a role model for other nations. It is quite prosperous thanks largely to a modest burden of government. There is remarkable ethnic and religoius diversity, but virtually no tension because power is decentralized (sort of what America’s Founders envisioned for the United States). Yet despite these — and many other — attractive features, Switzerland is being persecuted because of strong human rights laws that protect financial privacy. Money-hungry politicians from other nations resent Swtizerland’s attractive policies, and they would rather trample Swiss sovereignty rather than fix their own oppressive tax laws.
“This decision finally recognizes that German homeschoolers are a specific social group that is being persecuted by a Western democracy,” said Mike Donnelly, staff attorney and director of international relations for Home School Legal Defense Associaton. “It is embarrassing for Germany, since a Western nation should uphold basic human rights, which include allowing parents to raise and educate their own children. This judge understood the case perfectly, and he called Germany out. We hope this decision will cause Germany to stop persecuting homeschoolers,” he added.Read more here.
By Daniel J. MitchellA Swiss court just threw a wrench in the gears of an IRS effort to impose bad U.S. tax law on an extraterritorial basis, ruling that Switzerland-based UBS does not have to hand over data to the American tax authorities. This ruling nullifies an agreement that the Swiss government was coerced into making with the U.S. government last year.
In typical arrogant fashion, the IRS already has indicated that it still expects acquiescence, notwithstanding Switzerland’s strong human rights policy on personal privacy. The Bloomberg story excerpted below has the details, but it’s worth noting that this entire fight exists solely because the Internal Revenue Code imposes double taxation on income that is saved and invested, and imposes that bad policy on economic acti...

Here is a letter I wrote to forth.ie
Sir,
On 7 December I wrote an opinion for this site about the launch of identity cards in Manchester. I received one comment, from Joan Burton, who wrote: “It’s a cliche but a true one – if you’ve done nothing wrong you have nothing to fear.”
One of the problems about the current UK government’s overarching surveillance project has been a lack of debate, both publically and in parliament, so I welcome any engagement with these issues. I have heard the above sentiment voiced before and I address it here to provide clarification and, I hope on Ms Burton’s part, reevaluation.
Public protection from criminal activities is a key responsibility of the state but this should not allow the state whatever means it wishes in the pursuit of this...

"New Hampshire home educators protesting proposed government regulations making NH the most difficult state to home school. It is a short account of why these ordinary families came out in frigid New England weather to voice their concerns to the New Hampshire legislature. A suprising mix of people with differing political, religious and social views gathered in a unified stance against their representatives." (Source: Aspie Home-Education)

* The Guardian, Monday 11 January 2010We believe that schedule 1 of the children, schools and families bill represents an unacceptable imposition of state control over families. Although it is aimed at children educated outside the school system, it has implications for all families.Most parents would not make home-based education their first choice; but any family might need it if school seriously failed their child. Currently, this choice is lawfully available to all parents. If enacted, the bill would – for the first time – transfer responsibility for a child's education from the parents to the state. We believe this is a matter which should be of great concern to everyone.A change in the law is unnecessary. Parents are already required by law to provide an education suitable to the...

We are being made criminal in our own country." "I have home educated my 14 and 22 year old from scratch with no interference from the state. My eldest gained a first class honours degree from Imperial College in Computing and Maths and now has an excellent job with a local games development company.""Quite a lot of children are withdrawn from school because they have learning difficulties that the school cannot deal with and some because they have been abused and bullied by other school children.
I’d written long ago about my take on the Queen song, “Under Pressure“. I still love that song, and crank it up when I hear it. To me, it communicates the weight of acceptance in society for many.
I ran across this video from the guys at Tranquil sometime last year while surfing the web. Sure, it’s a rough take (and admittedly so by them) in spots, but I love the song (and their cover), and I dig the basement collaboration.

If you have a favorite song about acceptance, please mention it in the comments. (Source: Autism Street)

Jo Coulter, who educates her child at home, said: “I am absolutely horrified at the thought that in the name of child protection, thousands of children in my country would be subjected to this degree of exposure to strangers, within their own homes. Such treatment I thought was reserved for those suspected of committing a crime. Indeed, why stop at home educating families? Why not extend these measures throughout the land to cover all homes? After all, if school children only spend around seven hours a day in school, this leaves them out of ‘school protection’ for nearly seventeen hours a day, on week days, forty-eight hours at the weekend and many more over holidays. Indeed it is questionable if children are at all safe anywhere, even when they are in school. It is deeply offensive...

Human Rights Watch has just released a lengthy report detailing the constant and blatant abuses of human rights and basic individual freedoms in Cuba under the rule of Raul Castro.
Some hoped that the timid economic reforms announced by the “younger” Castro brother, when he assumed the official leadership of the geriatric regime, would constitute the opening salvos toward a more open and freer Cuba. However, a few of us spotted cracks in that fairy tale early on.
The recent beatings of Yoani Sánchez and other independent bloggers (described here by my colleague Ian Vásquez) are a clear reminder that, in Cuba, it’s business as usual under the Castro brothers’ rule. (Source: Cato-at-liberty)

In a new Policy Analysis, Cato Research Fellow Jason Kuznicki examines the ongoing threats to free speech both at home and around the world, from hate-speech laws in the United Kingdom and Canada and university speech codes in the United States, to the Cairo Declaration on Human Rights in Islam:
The result is not more happiness, but a race to the bottom, in which aggrieved groups compete endlessly with one another for a slice of government power. Philosopher Robert Nozick once observed that utilitarianism is hard-pressed to banish what he termed utility monsters—that is, individuals who take inordinate satisfaction from acts that displease others. Arguing about who hurt whose feelings worse, and about who needs more soothing than whom, seems designed to discover—or create—utility mon...

My response:
This morning, both Bret Stephens, in the Wall Street Journal, and Mona Charen, at Real Clear Politics, catalogue Obama’s silence on human rights — China, Tibet, Sudan, Iran, Burma, Honduras — and his backpedaling from his campaign rhetoric. Meanwhile, Eric Posner, at the Volokh Conspiracy, rightly credits Obama for, among other things, not backing the Goldstone Report and pressuring Spain to water down its undemocratic “universal jurisdiction” statute, even as he condemns the administration, again rightly, for its decision to join “the comically named U.N. Human Rights Council,” bastion of some of the world’s worst human rights abusers.
What’s missing, it seems, is...

Today is a federal holiday in the United States, the one we call "Labor Day." In most countries the labor movement celebrates on May 1 (May Day), but the origin of the US holiday ironically was in Canada where the fight for the nine-hour working day in the 1870s was celebrated at the end of summer. American labor leader Peter J. McGuire saw one of these celebrations and organized the first one in New York in 1882. After US soldiers and marshals put down a peaceful strike at the Pullman plant in bloody fashion in 1894, a fear of escalating labor unrest (the depression of 1893 was in full swing) led Grover Cleveland and a terrified Congress to make Labor Day a federal holiday, thereby separating it from the international workers' day in May and throwing a sop to labor.

The Washington Post reports that despite reports of widespread violence and human rights abuses since Mexico increased its fight against the drug trade, the U.S. government is considering pumping more money to their failing efforts:
The Obama administration has concluded that Mexico is working hard to protect human rights while its army and police battle the drug cartels, paving the way for the release of millions of dollars in additional federal aid.
The Merida Initiative, a three-year, $1.4 billion assistance program passed by Congress to help Mexico fight drug trafficking, requires the State Department to state that the country is taking steps to protect human rights and to punish police officers and soldiers who violate civil guarantees. Congress may withhold 15 percent of the annual ...

I’m learning guitar. Recently I went to visit Alex, my tutor, and briefly overlapped with the student who was before me; he’s a pleasant young man of perhaps 10 years old. Also in the room was his father. He looked a bit glum. I assumed that this man was simply there, somewhat begrudgingly, to collect his son but Alex said that he routinely sits in for the duration of his son’s lessons. Apparently this is common practice amongst parents these days.
The parents of Alex’s students aren’t prepared to give him the benefit of the doubt and assume that he’s not a paedophile. I was surprised by this initially, but then when I thought about it some more I was surprised that I had been surprised, because the risk of an abuser taking advantage of one’s child is now one th...

By Ravi Chandiramani, EditorGraham Badman's review of home education has created an unrivalled storm of protest on CYP Now's online discussion forums in the past couple of months. Scores of parents are livid at his proposals.Unfortunately for them, the government has said it will implement these in full. Mindful however of the army of home educators opposed to interference from the state, the Department for Children, Schools and Families has put them out to a public consultation first.Badman's recommendations would mean parents who choose to educate their children from home become regulated like never before. Chief among the proposals are a compulsory registration scheme; annual statements outlining parents' educational approach and objectives for the coming year; and the right for local a...

Ms Preuss, spokes person for Scotland's national home education support organisation, said:"It will be a sad day for English citizens if they are to be persecuted for choosing to care for and educate their own children in accordance with a long established legal right. If MPs do not reject these draconian proposals when they come before the UK Parliament, Schoolhouse anticipates an influx of home educating refugees from south of the border. England's loss will be Scotland's gain as we have plenty of room for well educated, motivated and enterprising people who place the same high value on freedom that we do."Read it here.
Last week, British homeschoolers were alarmed to find that the British Secretary of State for Children, Schools and Families accept a report on British education created by Graham Badman, a former Managing Director of Children, Families and Education in the County of Kent.The report recommended that the national government forcibly register all children that are not attending class in state schools and also suggested a mandate that homeschools be further regulated. Additionally, it was recommended that the state assume the power to enter the private homes of homeschooled children in order to make sure that government strictures are being observed.The underlying source by which Badman claims legitimacy for his report is the UNCRC. According to the Home School Legal Defense Association here ...

This novel comes to mind whenever I think about control orders, which were introduced by the British Government in the Prevention of Terrorism act in 2005 in response to the House of Lord’s ruling against indefinite detention without charge or trial for foreign nationals contained in the Anti-terrorism Crime and Security Act 2001.

And then there arose, across a spectrum ranging from the scientists and engineers writing in the Bulletin of Atomic [...] (Source: My journey with AIDS)

People with mental illness are increasingly ending up being imprisoned, rather than in the mental health care system where many of them belong. With the down economy, states and counties — who are primarily responsible for the health of the indigent — cut social services first. And with most public psychiatric hospitals long-since closed, people who have a mental disorder end up being warehoused not in hospitals, but in prisons.
Yes, we succeeded in closing down the state mental hospitals. But we moved the population not to outpatient facilities, but to our prisons.
Now, finally, people are realizing the short-sightedness of locking people with mental illness up, as the spiraling prison costs of doing so become a burden to cash-strapped local governments.

In conclusion
I don’t intend to conclude that the TAM7 moderator had any specific intentions other than to stimulate discussion (perhaps even play “devil’s advocate”). And other than the autism vaccine nonsense, I imagine that in-depth discussion of the implications of discussing autism doesn’t come up too frequently for most skeptics. But, for the thoughtful and scientifically-minded out there, put this in your head for future thought.
If the opportunity to discuss Jenny McCarthy’s anti-vaccine advocacy arises, consider adding clarity for why Jenny McCarthy (or parents in similar situations) really deserve understanding. Perhaps ask questions, distinguishing the connotative meanings of “comprehending Jenny McCarthy’s seeking to place blame&...

"Education is first and foremost the duty of the parent rather than the state.... Parents may delegate this educational responsibility to those whom they trust, but this delegation in no wise removes their responsibility for the education of their children.In other words, Badman has his priorities reversed. It is not that homeschoolers should submit to education authorities - it is that, if parents choose to send their children to a collective school, rather than educate them at home, the school must still educate them according to the wishes and direction of the parents. The teacher is in loco parentis."Read more... (Source: Aspie Home-Education)

The gravest threat to the survival of the repressive regime in Tehran may be the continuing attacks on its perceived legitimacy. Part of the factional infighting undoubtedly reflects a simple power struggle. However, religious principles also appear to be at stake. A number of Muslim clerics are denouncing the authorities for their misbehavior.
For instance, Iranian cleric and blogger Mohsen Kadivar recently applied several Islamic principles to the Iranian government:
The fourth question concerns attempts by some to cite the protection of the Islamic state to justify suppressing people’s efforts to defend their own rights.
The response is that an Islamic state cannot be protected through violence.
The fifth question is about what Shari’a law says are the signs of suppr...

At the end of this past week, I was fortunate to be invited back to the USD Summer Austism Institue to participate in a presentation with other Autism-Hub bloggers. At USD, and with some updated content, we were given the opportunity to talk about the Autism-Hub. Steve D provided some background about the hub and blogging in general, as well as opening with some excellent selected pieces (my humble opinion of course):

Science may know no borders but scientists have nationalities. Many live within the countries where they have citizenship, while many travel to where they can do more and better science. In the 21st century no nation can afford to squander its scientific talent. But some do it, anyway, either in small ways (failing to support science) or in Big Ways (oppressing free inquiry and free expression). No country is perfect, but some excel in this kind of stupidity. Even before the recent national uprising Iran's government was distinguishing itself in the irrationality and anti-science department (see here, here, here). Now we are seeing it in full flower: Read the rest of this post... | Read the comments on this post... (Source: Effect Measure)

Christine also has an interesting post on proposed legislation on breast implants and informed consent.

This report is a totally disproportionate response to a 'perceived' problem full of unsubstantiated allegations that home educated children are more at risk than those at school. This is simply not true and enacting the recommendations in this report would establish the state as parent of first resort. To allow LA staff access to private homes to interview children without their parents when there is no reason to suspect abuse is outrageous.You can sign it here.
All eyes are on Iran as young people struggle for basic freedoms: to assemble, to speak freely, to participate in civil society regardless of gender. It's a struggle not special to Iran. For some Americans, winning those rights is within recent memory. And when I was a young man, I had contemporaries who didn't live to see it. In the historic Freedom Summer of 1964, 45 five years ago today, three of them -- James Chaney, a 21-year-old black man from Meridian, Mississippi, Andrew Goodman, a 20-year-old white anthropology student from New York, and Michael Schwerner, a 24-year-old white social worker and organizer for the Congress for Racial Equality from New York -- died in the struggle: Read the rest of this post... | Read the comments on this post... To suggest that home education might lead to abuse ill becomes a Government at a time when a state-regulated nursery is being investigated over horrific crimes."Home schooling to be monitored by govt database?Nick Seaton, chairman of the Campaign for Real Education, said: "The whole purpose of home education, of course, is that people want to keep their children out of the clutches of the state and they should be allowed to do so if they want in a free country."Even from the edge of the...

The Situation of Human Trafficking – Abstract

This article suggests that a central reason for the limited success in preventing human trafficking is the dominant conception of the problem, which forms the basis for law developed to combat human trafficking. Specifically, the author argues that “otherness” is a root cause of both inaction and the selective nature of responses to the abusive practice of human trafficking. Othering operates across multiple dimensions, including race, gender, ethnicity, class, caste, culture, and geography, to reinforce a conception of a virtuous “Self” and a devalued “Other.” This article exposes how this Self/Other dichotomy shapes the phenomenon of human trafficking, driving demand for trafficked persons, influencing perceptions of the problem, and constraining legal...

The HRC’s press release states that:
Cuba had withstood many tests, and continued to uphold the principles of objectivity, impartiality and independence in pursuance of the realisation of human rights. Cuba was and remained a good example of the respect for human rights, including economic, social and cultural rights. The Universal Periodic Review of Cuba clearly reflected the progress made by Cuba and the Cuban people in the protection and promotion of human rights, and showed the constructive and responsive answer of Cuba to the situation of human rights. Cuba was the victim of an unjust embargo, but despite this obstacle, it was very active in the field of human rights. (Source: Cato-at-liberty)

Will it take multiple trips to any number of combinations of Supreme Court Justices of the future to wrest equality from the government, as it did here in Canada? I hope not.

After 20 years China has made substantial economic progress, but the ghosts of Tiananmen are restless and will continue to be so until the Goddess of Liberty is restored.
The Chinese Communist Party’s “Human Rights Action Plan” (2009–10) addresses several human rights abuses, but it fails to establish a well-defined boundary between the individual and the state that protects rights to life, liberty, and property.
Until China limits the power of the CCP and allows people to exercise their natural rights, there will be corruption, and the goal of “social harmony” will be elusive. The lesson of Tiananmen is that the principle of nonintervention (wu wei) is superior to the heavy hand of the state as a way to bring about true harmony.

It would be easier for North Carolina Rep. Virginia Foxx to drive a school bus through a subway turnstile than to try and explain herself via an attempted apology.
Appearing on MSNBC’s Rachel Maddow Show, the mother of Mathew Shepard, Judy, said the Congresswoman was apologizing for semantics, not the sentiments expressed.

Do trade and economic growth conflict with human rights?
Too often, human rights advocates present development as incompatible with rights. So-called development agencies like the World Bank often ignore rights, including personal choice, when they push for top-down growth strategies around the world. Jean-Pierre Chauffour will speak at the Cato Institute tomorrow on his new Cato book, The Power of Freedom: Uniting Human Rights and Development, where he takes the human rights and development “communities” to task for working at cross purposes and muddled thinking.
Sign up here or watch online to hear him present a development agenda that respects the full range of human rights. Susan Aaronson of George Washington University will comment. (Source: Cato-at-liberty)

Tomorrow is the sixth anniversary of the death of peace activist Rachel Corrie, crushed to death by a caterpillar tractor driven by the Israeli Defense Forces in occupied Palestine. She was trying to negotiate with the driver not to destroy the homes of Palestinians being subjected to collective punishment for demonstrating against the occupation (see our posts here, here, here). What makes this year's anniversary even more painful is fresh news: 37 year old Tristan Anderson from Oakland, California, a dedicated pacifist with the International Solidarity Movement (ISM), is on life-support after being shot in the face by the IDF with a high velocity tear gas canister. In some “extreme cases”, I’m sure home education could be a cover for not just abuse and forced marriage, but for child experimentation, low-cost manned Moon missions and possibly even cotton mills. Oh where, Baroness, is the evidence for this massive flap you are in?
Some people noticed a remarkable thing that happened on the Washington Mall on Sunday at the Obama pre-Inaugural concert, a part of which I posted on Tuesday. The second last appearance was by Pete Seeger, his grandson Tao and Bruce Springsteen singing Woody Guthrie's This Land is Your Land. What made it remarkable is the inclusion of three verses from the original version that are rarely heard under any circumstances and never heard in the corridors of power, much less in front of a world wide audience and in the presence and in honor of someone about to ascend to the Presidency of the United States. The verses were included at Pete Seeger's request. Pete is one of my heroes. Read the rest of this post... | Read the comments on this post... (Source: Effect Measure)

It seems to be happening all over the place. In the USA, two bills raise red flags among Oklahoma homeschoolers. In the UK the home educating community is beginning to feel persecuted by the government's allegations that home educating parents could be abusing their children in all sorts of ways, from forced marriages and neglect to sexual exploitation and domestic servitude. Under the pretext of ensuring children's education and welfare, the DCSF launches home education review.What do home educating parents have to say about this? Are home-schooled children more vulnerable?"I think it's nonsense. Things go on behind closed doors whether or not children attend school. Schools are enormous now and children are often reduced to the status of a number. I was told of a girl who was discovered ...
