Once again, a big drugmaker has made a payment to a state in order to settle charges of inflating the average wholesale prices of its medicine. This time, AstraZeneca agreed to pay $2.5 million to Idaho, which argued its citizens were harmed because the state Medicaid program unnecessarily paid too much for various drugs.
“Where published prices are false or misleading, the taxpayers are significantly harmed by excessive Medicaid reimbursements,” Idaho Attorney General Lawrence Wasden says in a statement. “Investigation by my office has revealed that the reported average wholesale price often is not related to the actual wholesale price paid for the drug.”
In one example cited. a unit of the Prilosec heartburn had a published average wholesale price of $4.134 in 2003, but in fact,...

South Dakota: Second State to Ignore NCLB Requirements

By Andrew J. CoulsonSouth Dakota joined Idaho this week in declaring that it will not raise its student proficiency targets next year as required by the NCLB. Under the law, states have been required to bring increasing percentages of their students up to the “proficient” level on their own tests. By 2014, NCLB demands that all students be deemed proficient by their respective state departments of education.
The belief driving NCLB was that, if we we raise government standards for what students are supposed to know and be able to do, they will learn more. They haven’t, according to the best, nationally representative indicator of academic outcomes: the NAEP Long Term Trends tests. By the end of high school, overall student achievement is no better today than it was 40 y...

Idaho Tubal Reversal Angels: Jaime and Kraig

Jamie and Kraig are two tubal reversal angels who have recently graced the staff of Chapel Hill Tubal Reversal Center. After the tragic death of their newborn, these angels sought the hope of restored fertility through the reversal of 'permanent' tubal sterilization. Within 4 months of the death of her newborn son and within 2 months after her tubal reversal, Jamie was pregnant again. Her due date is exactly the same date - 12 months from the day - that her son Kohl passed away. (Source: Tubal Reversal Blog)

Idaho Futile Care Bill S. 1114 Stalled in House Committee--For Now

This is a follow up report about an urgent futile care threat we warned against twice last week at SHS (here and here): After being caught flat footed with the passage of S. 1114 through the Idaho Senate--a bill that would, in part, legalize futile care theory in Idaho and specifically authorize doctors to disregard a patient's advance written directive wanting life-sustaining treatment--opponents have gotten in the saddle. My sources tell me that real damage has been done to the futile care provisions as people began to look at what is really being proposed. As a consequence, a hearing that had been set in the House Health and Welfare Committee has been postponed. That's good, but the bill--or at least the futile care part of it, since it is an omnibus involving many matters--isn't dead ye...

Duty to Die in Idaho! Legislature Close to Passing Futile Care Bill

The legislative process has become so overwhelming, that unless one hires a professional lobbying group to keep track, laws can pass quietly without any public attention at all. That seems to be the case in Idaho, where the Senate has passed a Texas-style futile care bill. The bill is so bad, it permits doctors who want to refuse wanted treatment to violate a patient's written advance directive. From the bill, S. 1114, section 394504A (4):If the ethics committee agrees with the attending physician that the treatment requested by the patient, the patient's advance directive or surrogate decision maker is medically inappropriate or futile, the attending physician and health care facility shall take reasonable action to assist the patient or surrogate decision maker to arrange the patient's tr...

If you live in Idaho, you should know that the ”number of Idaho residents diagnosed with diabetes has tripled in the past decade, outpacing rates that are soaring across the country.” ~source
The figures are from a large diabetes study that was released recently from the U.S. Centers for Disease Control and Prevention.
But what could be the cause? One nurse in the study felt that some people are simply more aware of the signs of diabetes and are going in for treatment. Others feel it’s just part of the trend where diabetes is, unfortunately, on the rise.

The Gem State is the latest to sue the drugmaker over allegations that its Zyprexa antipsychotic was improperly marketed, costing the state’s Medicaid program untold sums of money, according to The Idaho Statesman.
The Idaho lawsuit contends Lilly illegally marketed Zyprexa for uses not approved by the FDA and that marketing efforts directed at doctors encouraged them to prescribe the pill for “anxiety, phobic disorders, neurotic depression, affective personality disorder, sleep disorder, depression, attention deficit disorder, insomnia and separation anxiety,” according to the lawsuit, the paper writes.
Numerous states have filed similar suits against Lilly or are holding talks, although so far, only Alaska has reached a settlement last March, which amounted to $15 milli...

In Moscow, Idaho residents met to discuss the rise of crime in their community. The main incident in discussion was Jason Hamilton’s deadly rampage in May. Hamilton – who had a history of mental illness – killed his wife, a Moscow police officer, a church sexton and then himself, in the deadliest shooting in the town’s history.Among the suggestions of increasing officer training and weapons bans, Second District Judge John Bradbury offered the following perspective:He said society has criminalized mental illness because the current system does not allow intervention before a crime is committed.“It's the only time, when we have a medical problem, that we wait until it has gotten so bad that somebody's actually in physical danger, that we intervene. And, I'm equally concerned about...
