Progressive Nation » Blog Archive » Hoekstra Blames Obama For Fort Hood Massacre:"Hoekstra and Rep. Mike Rogers (R-MI) charged that terror-fighting tools used until recently by the intelligence community had lately been restricted or placed off limits by the administration. “We know that there are tools and methods that were in use just a few months ago are not in use today,” said Rogers. “That is a problem.”The GOPers declined to say which tools they were referring to, or to produce any other evidence to back up their claim. Nonetheless, they blamed the Obama administration’s political philosophy. Rogers referred to the administration’s decisions to close Guantanamo and to try Khalid Sheikh Mohammed in a civilian court as examples of the administration’s approach, before d...

Glenn Greenwald is suffering the effects of a very severe moral wedgie. Like many, and I include myself, he suffers from deep, impotent outrage toward the moral failure of the Obama Administration; it's abandonment of it's clear, legal duty to prosecute war crimes committed under the aegis of the Bushistas. He waxes sarcastic and wroth, no doubt in part due to the fact that he is being studiously ignored by those who have the manifest duty to act."Criminals"? "Prosecutions"? "Obliged to open a case"? "Violations of human rights"? Just because they maintained a few secret prisons in violation of domestic and international law? What kind of crazy, purist, Far Leftist utopians are running that place? They need a heavy dose of pragmat...

Obama, International Law, and Free Speech

Stuart Taylor has a very good article this week about the Obama administration, international law, and free speech. This excerpt begins with a quote from Harold Koh, Obama’s top lawyer at the State Department:
“Our exceptional free-speech tradition can cause problems abroad, as, for example, may occur when hate speech is disseminated over the Internet.” The Supreme Court, suggested Koh — then a professor at Yale Law School — “can moderate these conflicts by applying more consistently the transnationalist approach to judicial interpretation” that he espouses.
Translation: Transnational law may sometimes trump the established interpretation of the First Amendment. This is the clear meaning of Koh’s writings, although he implied otherwise duri...

This fall, the Supreme Court will hear two cases involving Eighth Amendment challenges to the sentencing of juveniles to life without parole (”LWOP”) – Graham v. Florida and Sullivan v. Florida — claims that these types of sentences are “cruel and unusual.” Cato takes no position on the wisdom of these types of sentences, but when evaluating their constitutionality the Court should only consider American law.
That is, regardless of the criminological or moral merits of juvenile LWOP sentences, the Supreme Court ought not consider non-binding provisions of international human rights treaties and customary international law in its analysis (as it has in cases like Roper v. Simmons and Atkins v. Virginia). To that end, Cato joined the Solidarity Ce...

The Situation of Human Trafficking – Abstract

This article suggests that a central reason for the limited success in preventing human trafficking is the dominant conception of the problem, which forms the basis for law developed to combat human trafficking. Specifically, the author argues that “otherness” is a root cause of both inaction and the selective nature of responses to the abusive practice of human trafficking. Othering operates across multiple dimensions, including race, gender, ethnicity, class, caste, culture, and geography, to reinforce a conception of a virtuous “Self” and a devalued “Other.” This article exposes how this Self/Other dichotomy shapes the phenomenon of human trafficking, driving demand for trafficked persons, influencing perceptions of the problem, and constraining legal...
